The concept of preventive diplomacy has captivated the United Nations since it was first articulated by Secretary-General Dag Hammarskjöld a half-century ago. Successive generations of diplomats and statesmen have invested in the idea that diplomatic efforts might be able to head off international conflicts and disasters. The persistence of human rights violations around the world clearly demonstrates the need to focus more attention on preventive action. Consequently, international organizations are increasingly strengthening the preventive dimension of their human rights activities. Preventive mechanisms have also emerged and continue to gain ground at the national level. These new realities, however, seem to have received little attention by the academic community. Yet they raise many important issues, which need to be further explored. The above considerations prompted the Marangopoulos Foundation for Human Rights to mark its twentieth anniversary by organizing an International Colloquy on the topic of the prevention of human rights violations. The present Volume contains contributions by the participants, based on the reports they presented at the Colloquy, substantially revised and updated. It constitutes the first attempt at a systematic analysis of the subject of the prevention of human rights violations, focusing on the following five aspects: conventional regimes, non-conventional monitoring mechanisms, international commissioners and Ombudsmen, national Ombudsmen and human rights institutions and the development of a human rights culture. This book documents the current global refugee crisis and examines the interrelated factors of immigration enforcement, international human rights law, political violence, and refugee protection. There are two disparate components to the global refugee crisis: first, there are about 46 million refugees and Internally Displaced Persons (IDPs), most of whom are struggling to survive in the poorest and most violent countries in the world, and second, our interpretation of international human rights law allows this state of affairs to worsen. Refugee protection has been a longstanding policy that ostensibly protects victims of human rights violations from other countries. In actuality, protection is largely negated by systematic efforts by industrialized states to reduce the number of refugees arriving at the borders. This book provides a comprehensive examination of this worldwide problem and rejects the idea that the majority of asylum seekers abuse the system to gain entrance into the country.
