This title was first published in 2001: During the last twenty years government rhetoric in the UK has increasingly advocated that statutory health and social care services should regard and treat recipients as 'consumers' in the same way as companies and organizations in the private sector. This involves a considerable cultural change on the part of both service providers and their clients, and this timely study explores the extent to which such a cultural change is actually taking place in British society. The utilization of welfare services by a sample of people aged 70 and above on discharge from inpatient care and in a short period afterwards is examined as a critical testbed for key components of consumerism, including participation, representation, access, choice, information and redress. The book explores not only the extent to which opportunities are being provided for users to play an active role in their care, but also their degree of willingness to assume such a role. By investigating the experiences of clients from a generation which might be considered relatively resistant to a more active participation in health and social care, the study offers an important insight into the extent to which a real social transformation is indeed taking place in the British welfare services.

The limited scope of participation in the making of EU law remains a continued source of controversy, featuring prominently in recent institutional and political developments that have been shaping the EU's constitutional framework - most intensely in the follow up of the Commission's White Paper on Governance. Yet little attention has been paid to participation rights as a means of ensuring the procedural protection of persons affected by EU regulation in its diverse forms. This is a dimension of the rule of law that has been largely ignored by EU legislative and judicial bodies. Not only the legislator, but also the Court of Justice and the Court of First Instance tend to adhere to excessively formal conceptions of participation rights that are premised on the right to be heard in individual procedures, as well as to a restrictive view regarding the relationships between the citizens and the administration. This book shows why, in the face of new regulatory developments, these conceptions are currently inadequate to ensure the legal protection of rights and interests affected by EU regulation. Combining a conceptual analysis with thorough empirical scrutiny, this book assesses the scope of participation rights in EU law against their rationales and underlying legal values. It makes a case for the extension of participation rights to new situations and new types of procedures, in particular those that would generally fall within the category of rulemaking. Yet existing response frameworks and emergency plans tend to homogenise affected populations as ‘victims’, overlooking the distinctive experience, capacities and skills of children and young people. Drawing on participatory research with more than 550 children internationally, this book argues for a radical transformation in children’s roles and voices in disasters. It shows practitioners, policy-makers and researchers how more child-centred disaster management, that recognises children’s capacity to enhance disaster resilience, actually benefits at-risk communities as a whole.
