On a reproché à ses membres d'être restés trop fidèles à des principes (assemblée unique, président de la République élu par le peuple) alors que, de jour en jour, l'ombre de Bonaparte menaçait. C'est injuste: chaque principe a été examiné dans son fondement (souveraineté du peuple, séparation des pouvoirs, égalité des citoyens), mais aussi en fonction de ses applications pratiques; certes, bien des constituants ont parfaitement vu ce que serait l'avenir, et certains l'ont même prophétisé en termes très clairs. Mais les conditions économiques et sociales étant ce qu'elles étaient _ une paysannerie déprimée par la chute des prix agricoles, des ouvriers dont les émeutes inquiétaient et enfin le souvenir de la gloire de l'Empire _, comment arrêter la montée de Louis Napoléon que les élections partielles plaçaient en tête des suffrages? Ce n'était pas par des textes constitutionnels qu'il était possible d'y parvenir. Les hommes de 1848 ont apporté beaucoup à la pensée constitutionnelle et politique de notre temps; il est bon de leur rendre hommage. En deux siècles, treize constitutions se sont succédé en France. Or une constitution n'est pas qu'un instrument juridique. Elle exprime toujours une certaine conception du pouvoir et de l'Etat, et traduit un rapport de forces politiques. D'où l'intérêt d'une Histoire des Constitutions, conçue non pas en termes de droit constitutionnel, mais comme un révélateur des idées et des forces politiques en France depuis la Révolution. François Luchaire, agrégé de droit public, professeur de droit constitutionnel, président honoraire de l'université de Paris-I-Panthéon-Sorbonne, conseiller d'Etat en service extraordinaire, a été membre du Conseil constitutionnel.

This collection discusses the concept of fraternity and examines the issue of its role in law. Since the end of World War II, fraternity has been cited in several national constitutional charters, in addition to the United Nations Universal Declaration of Human Rights. But is there space for fraternity in law? The centrepiece of this work is the French Constitution of 1958, portrayed by the author as an innovative hybrid construct whose arrival brought the constitutional stability that had eluded France for centuries. But the creation of the 1958 Constitution was not an isolated act; it represents part of an evolutionary process which continues to this day. Even though it is codified, the constitution of the Fifth Republic has evolved so markedly that some commentators have dubbed the present institutional balance the 'Sixth Republic'. It is this dynamic of the constitution which this book seeks to explain. At the same time the book shows how the French constitution has not developed in isolation, but reflects to some extent the global movement of ideas, ideas which sometimes challenge the very foundations of the 1958 Constitution.
