This edited volume examines the link between constitutional asymmetry and multinationalism in multi-tiered systems through a comprehensive and rigorous comparative analysis, covering countries in Europe, Africa and Asia. Constitutional asymmetry means that the component units of a federation do not have equal relationships with each other and with the federal authority. In traditional federal theories, this is considered an anomaly. The degree of symmetry and asymmetry is seen as an indicator of the degree of harmony or conflict within each system. Therefore symmetrisation processes tend to be encouraged to secure the stability of the political system. However, scholars have linked asymmetry with multinational federalism, presenting federalism and asymmetry as forms of ethnical conflict management. In 1995 none of the political parties representing the peoples of Bosnia preferred a federal option. Yet, Bosnia became a federal state, highly decentralised and with a complex institutional architecture. This solution was imposed on them by international actors as a result of peace negotiations following the Yugoslav wars. Political parties in post-war Bosnia were not willing to identify with or accept the federation. The international community intervened taking over key decisions and so Bosnia and Herzegovina became the first state to experience a new model of federalism, namely ’imposed federalism’ and a new model of a federal state, that of the ’internationally administered federation’. By combining comparative politics, conflict analysis and international relations theory Soeren Keil offers a unique analysis of federalism in post-Dayton Bosnia and Herzegovina. By exploring this model of ’imposed federalism’ not only does this study greatly contribute to the literature on developments in Bosnia and Herzegovina it also re-evaluates comparative federalism in theory and practice. This study also offers important conclusions for similar cases, both in the Western Balkans region and the wider world, where international involvement and federalism as a method of conflict resolution in diverse societies becomes ever more prevalent and important.

Political wisdom holds that the political boundaries of a state necessarily coincide with a nation's perceived cultural boundaries. Today, the sociocultural diversity of many polities renders this understanding obsolete. This volume provides the framework for the state-nation, a new paradigm that addresses the need within democratic nations to accommodate distinct ethnic and cultural groups within a country while maintaining national political coherence. First introduced briefly in 1996 by Alfred Stepan and Juan J. Linz, the state-nation is a country with significant multicultural—even multinational—components that engenders strong identification and loyalty from its citizens. Here, Indian political scholar Yogendra Yadav joins Stepan and Linz to outline and develop the concept further. The core of the book documents how state-nation policies have helped craft multiple but complementary identities in India in contrast to nation-state policies in Sri Lanka, which contributed to polarized and warring identities. The authors support their argument with the results of some of the largest and most original surveys ever designed and employed for comparative political research. They include a chapter discussing why the U.S. constitutional model, often seen as the preferred template for all the world’s federations, would have been particularly inappropriate for crafting democracy in politically robust multinational countries such as India or Spain. To expand the repertoire of how even unitary states can respond to territorially concentrated minorities with some secessionist desires, the authors develop a revised theory of federacy and show how such a formula helped craft the recent peace agreement in Aceh, Indonesia. Empirically thorough and conceptually clear, Crafting State-Nations will have a substantial impact on the study of comparative political institutions and the conception and understanding of nationalism and democracy.

Substate nationalism, especially in the past fifteen years, has noticeably affected the political and territorial stability of many countries, both democratic and democratizing. Norms exist to limit the behavior of collective agents in relation to individuals; the set of universally accepted human rights provides a basic framework. There is a lacuna in international law, however, in the regulation of the behavior of groups toward other groups, with the exception of relations among states. The book offers a normative approach to moderate minority nationalism that treats minorities and majorities in multinational states justly and argues for the differentiation of group rights based on how group agents are constituted. It argues that group agency requires a shared set of beliefs concerning membership and the social ontology it offers ensures that group rights can be aligned with individual rights. It formulates a set of principles that, if adopted, would aid conflict resolution in multinational states. The book pays special attention to national self-determination in transitional societies.
