La complejidad de estos productos determina la presencia de una serie de riesgos asociados a los beneficios que genera su uso. El empleo de estos productos se producirá en condiciones determinadas por la salud del consumidor y, en ocasiones, su elección no será llevada a cabo por quien vaya a utilizarlos, sino que será un facultativo quien lo haga, aunque los posibles inconvenientes derivados de su uso recaerán sobre el paciente. Estas particulares características establecen el marco del medicamento y el producto sanitario, como productos de consumo. Cuestiones como la publicidad, el precio, la responsabilidad derivada por productos defectuosos, los medicamentos falsificados, la adquisición de medicamentos a través de la red o el acceso a medicamentos en situaciones especiales (uso compasivo, medicamentos no autorizados y usos off label) son tratados con rigor, a través de los diferentes capítulos que configuran esta obra, aportando, sus autores, una nueva dimensión al estudio del medicamento y del producto sanitario relacionada con la protección al consumidor. El perfil profesional de los autores permite aportar una visión actual y práctica a los temas tratados por cada uno de ellos. The outsourcing of clinical trials to Latin America by the transnational innovative pharmaceutical industry began about twenty years ago. Using archival information and field work in Argentina, Brazil, Costa Rica, Mexico and Peru, the authors discuss the regulatory contexts and the ethical dimensions of human experimentation in the region. More than 80% of all clinical trials in the region take place in these countries, and the European Medicines Agency has defined them as priority countries in Latin America. The authors raise questions about the quality of data obtained from the trials and the violation of human rights during their implementation. Their findings are presented in this volume, the first in-depth analysis of clinical trials in the region.

In this paper we analyze the incidence of the VAT and its effects on the income distribution. To identify these effects, we rely on two tax reforms undertaken in Mexico that increased the VAT rate for a group of cities and left the rest unaffected. We compare the inflation rate of the affected cities with the exempted cities before and after the law changed. We find that the effect on prices is limited and conclude that the burden of the tax is indeed shared between producers and consumers. Regarding welfare, we find that the VAT is progressive in both absolute and relative terms to the overall expenditure. Finally, we show that an identical change in the VAT rate when inflation is high and persistent doubles its pass-through to inflation and its welfare loss for the average household.
