L'objectif de cette étude est de déterminer si, dans quelle mesure et selon quelles modalités le droit international humanitaire est applicable aux opérations de paix, c'est-à-dire aux opérations militaires menées par l'ONU ou par des Etats membres sur son autorisation. L'analyse successive de la portée de l'obligation de respecter le droit international humanitaire, de la qualification juridique des opérations de paix en droit international humanitaire et des obligations de l'ONU conduit à affirmer le principe de l'applicabilité du droit international humanitaire aux opérations militaires de sécurité collective. L'application des règles de droit international humanitaire par les forces de paix pose plusieurs questions juridiques et problèmes opérationnels. Les règles de droit international humanitaire applicables diffèrent d'une opération à l'autre, notamment selon que l'opération est placée sous le commandement de l'ONU ou sous celui d'un ou plusieurs Etats autorisés par l'ONU. Outre la responsabilité pénale individuelle de leurs auteurs, les actes des forces de paix engagent la responsabilité internationale des sujets de droit dont relèvent leurs membres. Il peut s'agir, selon le type d'opération et les circonstances des faits en cause, de la responsabilité de l'ONU, des Etats ou de ces deux sujets de droit international simultanément. Enfin, les modalités concrètes de mise en œuvre des dispositions du droit international humanitaire au cours des opérations de paix apparaissent encore perfectibles aujourd'hui, malgré les progrès réalisés récemment, notamment par l'ONU.

International law has long differentiated between international and non-international armed conflicts, traditionally regulating the former far more comprehensively than the latter. This is particularly stark in the case of detention, where the law of non-international armed conflict contains no rules on who may be detained, what processes must be provided to review their detention, and when they must be released. Given that non-international armed conflicts are now the most common form of conflict, this is especially worrying, and the consequences of this have been seen in the detention practices of states such as the US and UK in Iraq and Afghanistan. This book provides a comprehensive examination of the procedural rules that apply to detention in non-international armed conflict, with the focus on preventive security detention, or 'internment'. All relevant areas of international law, most notably international humanitarian law and international human rights law, are analysed in detail and the interaction between them explored. The book gives an original account of the relationship between the relevant rules of IHL and IHRL, which is firmly grounded in general international law scholarship, treating the issue as a matter of treaty interpretation. With that in mind, and with reference to State practice in specific non-international armed conflicts - including those in Sri Lanka, Colombia, Nepal, Afghanistan, and Iraq - it is demonstrated that the customary and treaty obligations of States under human rights law continue, absent derogation, to apply to detention in non-international armed conflicts. The practical operation of those rules is then explored in detail. The volume ends with a set of concrete proposals for developing the law in this area, in a manner that builds upon, rather than replaces, the existing obligations of States and non-State armed groups.

This book is open access under a CC BY-NC 2.5 license. On April 22, 1915, the German military released 150 tons of chlorine gas at Ypres, Belgium. Carried by a long-awaited wind, the chlorine cloud passed within a few minutes through the British and French trenches, leaving behind at least 1,000 dead and 4,000 injured. This chemical attack, which amounted to the first use of a weapon of mass destruction, marks a turning point in world history. The preparation as well as the execution of the gas attack was orchestrated by Fritz Haber, the director of the Kaiser Wilhelm Institute for Physical Chemistry and Electrochemistry in Berlin-Dahlem. During World War I, Haber transformed his research institute into a center for the development of chemical weapons (and of the means of protection against them). Bretislav Friedrich and Martin Wolf (Fritz Haber Institute of the Max Planck Society, the successor institution of Haber’s institute) together with Dieter Hoffmann, Jürgen Renn, and Florian Schmaltz (Max Planck Institute for the History of Science) organized an international symposium to commemorate the centenary of the infamous chemical attack. The symposium examined crucial facets of chemical warfare from the first research on and deployment of chemical weapons in WWI to the development and use of chemical warfare during the century hence. The focus was on scientific, ethical, legal, and political issues of chemical weapons research and deployment — including the issue of dual use — as well as the ongoing effort to control the possession of chemical weapons and to ultimately achieve their elimination. The volume consists of papers presented at the symposium and supplemented by additional articles that together cover key aspects of chemical warfare from 22 April 1915 until the summer of 2015.
