On February 13, 2007 Luxembourg enacted the law on specialised investment funds (SIF Law). The SIF Law replaces the 1991 law on undertakings for collective investment (UCIs), commonly referred to as institutional investor funds, the securities of which are not intended to be offered to the public. The result is a lightly regulated, operationally flexible and tax-efficient investment fund regime for an internationally qualified investor base. From August 1, 2007 the Netherlands has introduced a tax-exempt regime for investment funds (vrijgestelde beleggingsinstelling or VBI). This regime is now available in addition to the existing FBI regime (fiscale beleggingsinstelling). This article looks at the changes to the funds regimes in both countries.
