Depuis les années 1960-1970, la situation environnementale est alarmante, notamment en raison des pressions exercées pour la satisfaction des besoins de la société de consommation. Cependant, il faudra attendre la tenue du Sommet de la Terre à Rio en 1992 pour que les Etats prennent conscience de la nécessité de modifier leurs modes de consommation non durables afin de mieux protéger les écosystèmes. Dans cette perspective, le concept de consommation durable, notion encore floue et mal définie, émerge. Tant au Québec, qu’en France, lentement, le droit de la consommation intègre des préoccupations environnementales afin d’inciter les consommateurs à se comporter en « consommateurs-responsables », en « consommateurs-citoyens ». Les pouvoirs publics disposent de plusieurs moyens pour atteindre cet objectif. Ainsi, le recours aux instruments de fiscalité environnementale, pour encourager les consommateurs à utiliser de manière plus rationnelle les ressources naturelles, se développe mais reste encore timide. Par ailleurs, l’éducation et la participation au processus décisionnel sont des éléments essentiels pour assurer aux consommateurs l’accès à l’information pertinente afin qu’ils privilégient l’achat de produits plus respectueux de l’environnement et des conditions sociales des travailleurs (ex : les produits biologiques et les produits issus du commerce équitable). Les choix des consommateurs restent toutefois largement conditionnés par les règles du marché (ex : normalisation privée) ; il est donc essentiel que les pouvoirs publics interviennent pour encadrer la mise en œuvre du concept de consommation durable.

This book provides a broad understanding of whether law plays a role in influencing patterns of sustainable consumption and, if so, how. Bringing together legal scholars from the Global South and the Global North, it examines these questions in the context of national, transnational and international law, within single and plural legal systems, and across a range of sector-specific issue areas. The chapters identify how traditional legal disciplines (e.g. constitutional law, consumer law, public procurement, international public law), sector-related regulation (e.g. energy, water, waste), and legal rules in specific areas (e.g. eco-labelling and packing) engage with the concept of sustainable consumption. A number of the contributions describe this relationship by isolating a national legal system, while others approach it from the vantage point of legal pluralism, exploring the conflicts and convergences of rules between multiple international treaties (or guidelines) and those between the rules of international and transnational law (or both) vis-à-vis national legal systems. While sustainable consumption is recognised as an important field of interdisciplinary research linking virtually all social science disciplines, legal scholarship, in contrast, has neglected the importance of the field of sustainable consumption to the law.
