Dans la partie suivante, une comparaison est faite avec la jurisprudence du Centre d'arbitrage et de médiation de l'OMPI, faisant application des règles UDRP dans les conflits qui opposent les propriétaires de marques, d'une part, et les propriétaires d'(similaires) noms de domaine, d'autre part, et dans lesquels la liberté d'expression est invoqué. Enfin, l'étude formule des suggestions quant à la construction d'une équilibre entre le système du droit des marques et le droit fondamental tel que protégé par l'article 10 de la Convention européenne des droits de l'homme. This article examines the extent to which the system of trademark law takes into account the freedom of expression, in general, and the right to parody, in particular. The study first discusses the legal provisions and the case law relating to this issue in the Benelux and France. In a following part, the paper analysis the case law of the WIPO Arbitration and Mediation Center applying the UDRP rules in conflicts between trademark proprietors, on the one hand, and owners of (similar) domain names, on the other hand, in cases where the free speech right was at stake. Finally, the paper makes suggestions as to how a balance should be maintained between the system of trademark law and the fundamental right protected by Article 10 of the European Convention on Human Rights.
