Aux États-Unis, l'administration fédérale est composée d'un ensemble d'entités, que le droit administratif appelle agences (agencies) et qui sont créées par le Congrès par voie législative. Sous la plume des juristes américains, l'expression d' « État administratif » traduit l'idée, surprenante pour un spécialiste de droit public français, qu'à l'échelon fédéral, ce sont surtout ces agences qui exercent les trois fonctions juridiques de l'État, à savoir la fonction législative, la fonction exécutive et la fonction juridictionnelle. Cette thèse part du constat qu'il y a, aux États-Unis, une certaine réticence à qualifier d' « État » le gouvernement fédéral. Le développement de la structure administrative fédérale, de la coercition administrative et du pouvoir discrétionnaire des agences impose-t-il néanmoins de reconnaître qu'un État fédéral, au sens que les juristes français donnent à ce terme, existe désormais aux États-Unis ? Cette thèse répond à cette question par la négative. Elle entend alors rechercher les caractères de l' « État » fédéral à partir d'une analyse des grandes théories du droit administratif américain. Tout d'abord, cet « État » ne repose pas sur l'idée d'une puissance publique, le droit administratif ayant cherché à organiser la soumission de l'administration à la rule of law. Ensuite, il ne poursuit pas la réalisation d'un intérêt général substantiel et transcendant, mais retient une conception procédurale de l'intérêt public. Enfin, il n'est pas fondé sur un principe d'unité du pouvoir, parce que le droit administratif n'adopte pas une conception hiérarchique de l'administration et ne lui confie pas la mise en œuvre d'une volonté politique unifiée.
