Le droit médical est en plein essor. Le soumettre à une analyse critique et constructive est l'objectif que se donne le Centre de droit médical et biomédical de l'Université catholique de Louvain. Dans cette optique, celui-ci a organisé, les 6 et 20 octobre 2006, un colloque intitulé " Actualités et perspectives du droit médical ". Les thèmes étudiés concernent les droits du patient et l'indemnisation sans faute des dommages liés aux soins de santé. Cet ouvrage constitue le prolongement des réflexions échangées lors du colloque. Il intègre les évolutions qui ont marqué ces thématiques jusqu'au début de l'année 2008. Les droits du patient- plus particulièrement, le droit au consentement libre et éclairé, le droit d'accès direct au dossier du patient et le droit à la médiation - sont ainsi examinés, tels qu'ils se présentent depuis l'entrée en vigueur de la loi du 22 août 2002. L'apport des dispositions légales, leur application et les difficultés qui s'y attachent font l'objet d'une étude approfondie. Le nouveau système belge d'indemnisation sans faute des dommages liés aux soins de santé est également soumis à un examen attentif. La pertinence de cette dérogation au droit commun de la responsabilité civile, les modalités possibles de la mise en œuvre et du financement de ce système sont soumis aux regards croisés d'experts, à la lumière du droit comparé. Cet ouvrage fait figure d'outil indispensable pour quiconque est interpellé par le droit médical.

The papers in this collection are drawn from a symposium held in Vienna in December 2010.
