Desde hace ya varios años, Colombia padece diversos problemas medioambientales, y el deterioro de la calidad del aire constituye uno de los de mayor gravedad y, por tanto, importancia. Tal deterioro ya ha causado efectos negativos en el entorno natural y en los habitantes del país, hoy continúa produciéndolos y, si el Estado y los particulares no lo afrontan correctamente, seguirá haciéndolo a lo largo de muchos años más. Por supuesto, dichos efectos son ambientales, pero también están relacionados con la salud, la vida e, incluso, la economía. En efecto, la pérdida de la pureza del aire incide notablemente en la morbilidad y la mortalidad de Colombia y, además, afecta de manera considerable el producto interno bruto nacional. No obstante, el deterioro de la calidad del aire no ha cautivado a los juristas colombianos. El Derecho del medio ambiente colombiano se ha venido desarrollando rápidamente tras la expedición de la Constitución de 1991 y, en consecuencia, la creación y la puesta en marcha de la Corte Constitucional. Hoy existe un vasto y diverso abanico jurídico-ambiental compuesto por normativa infraconstitucional, jurisprudencia y doctrina. Sin embargo, hay una excepción significativa: la doctrina jurídica colombiana no ha estudiado la pérdida de la pureza del aire ni los múltiples instrumentos jurídico-administrativos de gestión de la calidad del aire. Por consiguiente, este trabajo pretende contribuir a llenar tal vacío doctrinal a través del establecimiento ordenado, crítico y propositivo de los cimientos del régimen jurídico del aire, cimientos que permitirán emprender el análisis del resto de los elementos del régimen.
