La personne morale apparaît comme le terme réunificateur de tout système representative. Dans l'ordre international, ce processus est perturbé par la présence, dans les organs intergouvernementaux, de représentants d'Etat qui sont autant d'organes des Etats membres, présence prolongée par le consentement aux actes adoptés en leur sein. Quel en est donc le sujet d'imputation : l'organisation ou ses membres ? Une théorie de l'acte doit être développée au coeur de la théorie de l'organe pour démontrer que l'organisation internationale est la personnification juridique d'une collectivité d'Etats dotée d'un système représentatif, et n'est que cela. La qualité de partie à un traité constitutif et de membre d'une organisation internationale ne prive l'Etat d'aucun des attributs de la souveraineté dans l'ordre international. Au contraire, la faculté d'investir un sujet de droit de compétences nouvelles est précisément un attribut de la souveraineté : l'organisation est tout entière une création des Etats membres. Leur souveraineté n'inhibe pas le processus de personnification de l'organisation qui, en retour, ne la confisque pas : la souveraineté et la relativité des rapports juridiques demeurent les principes régulateurs de l'ordre international.

The way in which a society expresses grief can reveal how it views both intense emotions and public order. In thirteenth-century Italian communes, a conscious effort to change appropriate public reaction to death threw into sharp relief connections among urban politics, gender expectations, and understandings of emotionality. In Passion and Order, Carol Lansing explores a dramatic change in thinking and practice about emotional restraint. This shift was driven by politics and understood in terms of gender. Thirteenth-century court cases reveal that male elites were accustomed to mourning loudly and demonstratively at funerals. As many as a hundred men might gather in a town's streets and squares to weep and cry out, even tear at their beards and clothing. Yet these elites enacted laws against such emotional display and proceeded to pay the fines levied against themselves for violating their own legislation. Political theorists used gender norms to urge men to restrain their passions; histrionic grieving, like lust, was now considered "womanish." Lawmakers drew on a complex of gendered ideas about grief and public order to characterize governance in ways that linked the self and the state. They articulated their beliefs in terms of rules of decorum, how men and women need to behave in order to live together in society. Lansing demonstrates this change through a rich combination of sources: archival records from Orvieto, Bologna, and Perugia; political treatises; literary works, notably Petrarch's letters; and representations of grief in painting and sculpture.

Scholars have recently achieved new insights into the many ways in which the dead and the living interacted from the Late Preclassic to the Conquest in Mesoamerica. The eight essays in this useful volume were written by well-known scholars who offer cross-disciplinary and synergistic insights into the varied articulations between the dead and those who survived them. From physically opening the tomb of their ancestors and carrying out ancestral heirlooms to periodic feasts, sacrifices, and other lavish ceremonies, heirs revisited death on a regular basis. The activities attributable to the dead, moreover, range from passively defining territorial boundaries to more active exploits, such as ÒdancingÓ at weddings and ÒwitnessingÓ royal accessions. The dead wereÑand continued to beÑa vital part of everyday life in Mesoamerican cultures. This book results from a symposium organized by the editors for an annual meeting of the Society for American Archaeology. The contributors employ historical sources, comparative art history, anthropology, and sociology, as well as archaeology and anthropology, to uncover surprising commonalities across cultures, including the manner in which the dead were politicized, the perceptions of reciprocity between the dead and the living, and the ways that the dead were used by the living to create, define, and renew social as well as family ties.
