Book Description
In the process of resolving disputes, it is not uncommon for parties to justify actions otherwise in breach of their obligations by invoking the need to protect some aspect of the elusive concept of public order. Until this thoroughly researched book, the criteria and factors against which international dispute bodies assess such claims have remained unclear. Now, by providing an in-depth comparative analysis of relevant jurisprudence under four distinct international dispute resolution systems – trade, investment, human rights and international commercial arbitration – the author of this invaluable book identifies common core benchmarks for the application of the public order exception. To achieve the broadest possible scope for her analysis, the author examines the public order exception’s function, role and application within the following international dispute resolution systems: relevant World Trade Organization (WTO) agreements as enforced by the organization’s Dispute Settlement Body and Appellate Body; international investment agreements as enforced by competent Arbitral Tribunals and Annulment Committees under the International Center for Settlement of Investment Disputes; provisions under the Inter-American Convention of Human Rights and the European Convention of Human Rights as enforced by the Inter-American Court of Human Rights and the European Court of Human Rights, respectively; and the New York Convention as enforced by national tribunals across the world. Controversies, tensions and pitfalls inherent in invoking the public order exception are elucidated, along with clear guidelines on how arguments may be crafted in order to enhance prospects of success. Throughout, tables and graphs systematize key aspects of the relevant jurisprudence under each of the dispute resolution systems analysed. As an immediate practical resource for lawyers on any side of a dispute who wish to invoke or strengthen a public order exception claim, the book’s systematic analysis will be welcomed by lawyers active in WTO disputes, international investment arbitration, human rights law or enforcement of foreign arbitral awards. Academics and policymakers will find a signal contribution to the ongoing debate on the existence, legal basis, content and functions of the transnational public order.

Book Description
This book is the record of a case study: Chavismo and its destructive flaw in Venezuela over more than 15 years. It is about a regime that changed the country's democratic institutions. One that replaced the organization of the state to conform it to its convenience. A regime that expropriated productive agricultural, livestock and food businesses; that nationalized private land, buildings, shopping centers, warehouses, factories; that modified in their detriment the values of key institutions of society, such as the military and the oil industry. Hugo Chavez and his accomplices reversed the political and administrative decentralization of the state to focus government action on the President of the Republic. Venezuela was led to the edge of bankruptcy. Scarcity of basic staples became rampant in the country, health was taken to intensive care, and much of its industry was placed in ruins. Chavismo, as the expression of XXI Century Socialism, divided Venezuelans by promoting hatred among them. Criminality rose to unimaginable levels. Human rights were the most violated. These are the files to be used to judge Chavismo before history.

Book Description
The interconnectedness of the global environment and finiteness of the earth's natural resources require an increased understanding of environmental and natural-resource policy and politics in countries around the world. This is especially true of industrializing countries where widespread ecological disturbances and rapid exploitation of natural resources are taking place. Ecological Policy and Politics in Developing Countries provides an in-depth study of ecological problems, policies, and politics in ten major industrializing countries. Each chapter discusses the increasingly international context of domestic environmental policies and explores some of the powerful interests and institutional forces that contribute to ecological problems and shape the policies to deal with them in each country. The authors identify some of the major impediments to both well-designed environmental policies and their effective implementation. The ten countries included here—the Czech Republic, China, India, Indonesia, Mexico, Nigeria, Taiwan, Thailand, Slovakia, and Venezuela—cover five continents, over half of the world's population and most of the major industrializing countries. [Contributors include Lester Ross, Robert Cribb, Jonathan Rigg and Philip Stott, Juju Chin-Shou Wang, R. K. Sapru, Stephen P. Mumme, Pablo Gutman, Olusegun Areola, and Catherine Albrecht.]

Book Description
If subjecting war to law is one of the most important legal achievements of the 20th century, progressing further in that direction is one of the most important challenges for the 21st century. The problems it poses are many: the term “war” has formally fallen into disuse and we talk about “peacekeeping”; armies are today the product of cooperation between states and international organizations; private contractors increasingly participate in warlike activities, as the case of the Iraq war demonstrates; and the lines between war and very serious forms of crime (terrorism, organized crime) are increasingly blurred. This volume compiles the contributions presented at XVth International Congress on Social Defence, and tackle the criminal-legal issues raised by these new scenarios. It constitutes an innovative volume, gathering together the work of both academic and military authors, who have drawn on their theoretical and practical experience.

Book Description
