El presente estudio jurídico analiza en profundidad la figura establecida en el artículo 18.2 de la Directiva 95/46/CE y su posible inclusión en el sistema jurídico español en una futura y necesaria reforma legislativa en materia de protección de datos de carácter personal. Esta figura, conocida en términos anglosajones como «personal data protection official», y que podríamos traducir al castellano como «encargado de protección de datos de carácter independiente», tiene como principales cometidos: &● Aplicar al ámbito interno, de manera independiente, las disposiciones en materia de protección de datos de carácter personal. &● Llevar un registro de los tratamientos efectuados por el responsable, garantizando de esta forma que dicho tratamiento no pueda causar una merma de los derechos y libertados de los afectados o interesados En este sentido, el citado encargado de protección de datos de carácter independiente aún no se encuentra transpuesto al sistema jurídico español y en este punto se centra el presente estudio, analizando, de forma pormenorizada, las ventajas de su inclusión en el Derecho español, exponiendo detalladamente cómo la normativa en materia de protección de datos de carácter personal puede beneficiarse en ámbitos tales como la notificación de ficheros, las transferencias internacionales de datos o la aplicación de las medidas de seguridad. Asimismo se exponen los ejemplos de diversos Estados miembros de la Unión Europea, que han transpuesto, con éxito, esta figura a su Derecho interno, como puede ser el caso de Alemania o Francia. Por último, el estudio detalla cuáles son las características de esta figura jurídica y cómo se debería transponer correctamente al sistema jurídico español.
