La loi française sur les marques (1964 depuis 1991) sanctionne le titulaire d'une marque, qui n'en a pas fait un usage sérieux pendant une période ininterrompue de 5 ans, par la déchéance de ses droits sur les produits et/ou services non exploités. L'étude de 30 ans de jurisprudence permet d'énoncer les règles de procédure spécifiques à cette action : juridiction compétente - intérêt pour agir introduction de l'instance - dénouement de l'instance efficacité de la décision. Cette étude permet en outre de définir la notion d'usage sérieux, au sens de la loi, requis du titulaire attaque en déchéance (objet spécifique de l'usage sérieux - intensité de l'usage - instruments de preuve) ainsi que les limites du défaut d'usage sérieux (l'usage par un tiers - l'usage sous une forme modifiée- les justes motifs au non usage).
