This book examines the role played by domestic and international judges in the “flexibilization” of legal systems through general principles. LA RIFORMA DEL MERCATO DEL LAVORO Il volume costituisce un primo commento alla legge 28 giugno 2012, n. 92 “Disposizioni in materia di riforma del mercato del lavoro in una prospettiva di crescita”, nota anche riforma Fornero. Il testo prevede una suddivisione in quattro articoli: a) l’articolo 1 disciplina sia la flessibilità in entrata sia la flessibilità in uscita e le tutele del lavoratore e riporta le novità di maggiore impatto. In particolare ridisegna il regime di garanzie del lavoratore: nuova disciplina dei licenziamenti individuali e modifica dell’articolo 18 dello Statuto dei lavoratori, licenziamenti collettivi e introduzione di un rito specificamente dedicato alle controversie giudiziali aventi ad oggetto l’impugnativa dei licenziamenti finalizzato alla riduzione dei tempi del processo per quanto attiene a tali controversie e contraddistinto da caratteristiche di celerità e di snellezza. Altre novità toccano i contratti a tempo determinato (contratto di inserimento, di cui è disposta l’abrogazione, apprendistato, lavoro a tempo parziale e lavoro intermittente), il lavoro a progetto, l’associazione in partecipazione con apporto di lavoro e la disciplina delle partite IVA; b) l’articolo 2 riguarda gli ammortizzatori sociali. Raccoglie un complesso di misure volte ad estendere in chiave universalistica le tutele in caso di disoccupazione. Il legislatore prevede un sistema articolato su tre pilastri: l’assicurazione sociale per l’Impiego (ASpI), a carattere universale, le tutele in costanza di rapporto di lavoro (Cigo, Cigs, fondi di solidarietà) e gli strumenti di gestione degli esuberi strutturali; c) l’articolo 3 concerne le tutele in costanza di rapporto di lavoro. In particolare estende l’applicazione delle norme in materia di integrazione salariale anche a settori precedentemente non coperti e prevede l’introduzione di strumenti di sostegno al reddito dei lavoratori (i fondi di solidarietà); d) l’articolo 4 contiene ulteriori disposizioni sul mercato del lavoro. Ha un carattere residuale e si sofferma su alcuni aspetti non riconducibili alle fattispecie precedentemente trattate (sostegno ai processi di esodo dei lavoratori cosiddetti anziani, incentivi alle assunzioni, contrasto del fenomeno delle dimissioni in bianco, sostegno alla genitorialità, misure per l’inserimento e l’integrazione nel lavoro delle persone con disabilità, lavoratori stranieri, formazione permanente). Questa seconda edizione riporta le modifiche introdotte con la L. 134/2012 (di conversione del D.L. 83/2012, cosiddetto decreto crescita e sviluppo) e i primi chiarimenti forniti dal Ministero del Lavoro con la circolare n. 18 del 18 luglio 2012.
