Book Description
LA CONVENTION INTERNATIONALE DES DROITS DE L'ENFANT, RATIFIEE PAR LA FRANCE EN 1990, A INSTITUE L'ENFANT EN SUJET DE DROIT. CETTE AFFIRMATION DE LA SUBJECTIVITE JURIDIQUE DE L'ENFANT OPERE UNE RUPTURE AVEC LA PHILOSOPHIE DU DROIT NATUREL CLASSIQUE QUI, A L'EXEMPLE D'ARISTOTE, EN REDUISANT L'ENFANT A ETRE "QUELQUE CHOSE DU PERE", LUI INTERDISAIT TOUTE ALTERITE ONTOLOGIQUE ET JURIDIQUE. LA PHILOSOPHIE CONTRACTUALISTE DU DROIT NATUREL MODERNE EN NE RECONNAISSANT QUE DES INDIVIDUS LIBRES ET EGAUX PERMIT, NON SEULEMENT UNE PENSEE DES DROITS DE L'HOMME, MAIS RENDIT POSSIBLE UNE PHILOSOPHIE DES DROITS DE L'ENFANT. EN EFFET, A L'EGAL DE TOUT ETRE HUMAIN, L'ENFANT DEVENAIT TITULAIRE DES DROITS DE L'HOMME DES SA NAISSANCE, MAIS DU FAIT DE SON IMMATURITE, NE POUVAIT EN DISPOSER AVANT D'AVOIR RECU PROTECTION ET EDUCATION, CONDITIONS DE L'USAGE FUTUR DE SES DROITS SUBJECTIFS, ET QUI CONSTITUAIENT, EN PROPRE, LES DROITS DE L'ENFANT. C'EST, DANS UNE CERTAINE MESURE, DE CETTE PHILOSOPHIE QUE LA CONVENTION DES DROITS DE L'ENFANT S'EST DETACHEE. EN ERIGEANT L'ENFANT EN SUJET DE DROITS, ELLE EVACUAIT LA TEMPORALITE, LE DEVENIR ET LE DEVOIR-ETRE AUTONOME DE L'ENFANT, CARACTERISTIQUES QUI CONSTITUENT LE PROPRE DE L'ENFANT QUE ROUSSEAU, LE PREMIER, AVAIT DECOUVERTES. C'EST AU DIFFICILE CHEMIN VERS L'IDEE DES DROITS DE L'ENFANT QU'INVITE CE TRAVAIL PAR L'ETUDE DU STATUT JURIDIQUE QUE LES PHILOSOPHES CONTRACTUALISTES ONT DONNE A L'ENFANT. MAIS C'EST AUSSI LA MISE A JOUR DES DIFFICULTES DOCTRINALES RENCONTREES PAR LA REALISATION PRATIQUE DES DROITS DE L'ENFANT AU XIXEME SIECLE. DIFFICULTES QUI ONT TROUVE LEUR SOLUTION DANS LE REJET DE LA PHILOSOPHIE DU SUJET. EN PRENDRE LA MESURE, TELLE EST LA TACHE A ACCOMPLIR AFIN D'EN ASSURER LE DEPASSEMENT ET RETROUVER L'INSPIRATION DE LA PHILOSOPHIE CONTRACTUALISTE, CONDITION NECESSAIRE A UNE PHILOSOPHIE DES DROITS DE L'ENFANT

Book Description
This book offers a compact but general introduction to international human rights law. It discusses the theoretical, historical and legal foundations of international human rights law, providing an encompassing analysis of the substantive content of the most important human rights and of the role of States and non-State actors in ensuring their respect. It also carries out a specific analysis of the UN system and the ECHR and other regional systems – all this while constantly situating the discussion on international human rights law within the broader framework of public international law. While particularly suitable for undergraduate students in law, this book is also aimed at students of political science and other social sciences, as well as academics and practitioners. Pietro Pustorino is Full Professor of International Law at the Department of Law of Luiss University (Rome, Italy) and Director of the Luiss Center for International and Strategic Studies.

Book Description
Protecting children from sexual violence - A comprehensive approach is a collection of highly readable expert papers for both child professionals and the general public. It is divided into five parts, presenting a European overview and covering the existing legal frameworks; abuse prevention and reporting; rehabilitation and social reintegration of victims; sexual violence on the Internet; and public and private partnerships against abuse. It also sheds light on the little-known problem of children who are sexually abusing other children. In addition to providing thorough information on the many facets of this complex subject, this publication also highlights new concepts, facts and recommendations. Foremost is the significant lack of data on the prevalence and nature of sexual violence in Europe, underscoring the need for co-ordinated pan-European research and information gathering, which are vital to effective policy making and programme design. It also sounds the alarm for urgent co-ordinated action in various fields to drastically improve child protection through awareness raising; targeted and specialised training, intervention and therapy programmes; sex education in schools; responsible family attitudes; and justice systems with tighter abuse laws and which take account of children's special needs as reliable witnesses.Protecting children from sexual violence is published as part of the Council of Europe campaign to stop sexual violence against children. The hope is that this publication will inspire judges, the police, educators, governments, the media and legislatures to join the campaign and expose, demythify and take concerted action to combat sexual violence against children, a phenomenon that affects as many as 20% of children in Europe.

Book Description
This book deals with the implementation of the rights of the child as enshrined in the Convention on the Rights of the Child in 21 countries from Europe, Asia, Australia, and the USA. It gives an overview of the legal status of children regarding their most salient rights, such as the implementation of the best interest principle, the right of the child to know about of his/her origin, the right to be heard, to give medical consent, the right of the child in the field of employment, religious education of children, prohibition of physical punishment, protection of the child through deprivation of parental rights and in the case of inter-country adoption. In the last 25 years since the Convention on the Rights of the Child was adopted, many States Parties to the Convention have made great efforts to pass legislation regulating the rights of the child, in their commitment to the improvement of the legal status of the child. However, is that enough for any child to live better, safer, and healthier? What are the practical effects of this international as well as many national instruments in the everyday life of children? Have there been any outcomes in terms of improvement of their status around the world, and improvement of the conditions under which they live, since the Convention entered into force? In tackling these questions, this work presents a comparative overview of the implementation of the Convention, and evaluates the results achieved.

Book Description
Is historical knowledge important for education? How can we build a shared historical knowledge with schools, communities, and education professionals? The book responds to these questions by suggesting the public history approach, as applied in education and, more generally, to all professions that are based on human relations. The public history of education refers directly to North American experiences, but at the same time it is part of a process of European cultural acceptance and re-elaboration that has one of its main points of reference in the Italian Public History Association. The objective is not to make history for the general public, but to make public history with all those interested, in a collaborative and participative context, in the quest for meaningful knowledge, directly related to the current and challenging needs of our society.

Book Description
The present “revolution” in biological technology is leading lawyers to fundamentally reconsider the laws of human reproduction .What is at stake is not only the transmission of life but also the transmission of a certain order of the things on which society is based. This is the reason why the law has always sought to regulate the transmission of life. Covering themes from Canon and medieval Roman Law to the 1804 ‘Code civil’, the work includes twenty-three articles on the history of law about a number of modern-day questions. They deal with the close connections long maintained between marriage and procreation; with natural and legal "filiation" especially regarding the very delicate problems of evidence; with the institution of legitimation but also of the child as a person. There is also an article on the important matter of the "conceived child".
