Book Description
This book studies the normative intersection between integration, immigration and nationality in the European Union (EU). It examines the relationship between integration and the legal frameworks of admission, stay and access to nationality by third country nationals at national and European levels. Integration is being subject to multifaceted processes transforming its traditional policy and legal settings, as well as its classical theoretical premises and approaches. The Europeanisation of immigration policy has provoked the emergence of distinctive European approaches on integration. The legal elements of integration are being developed through two parallel settings: the EU Framework on Integration and European immigration law. These venues constitute two of the main pillars upon which the common EU immigration policy is being constructed, and their nexus raises several elements in need of reflection and study. This book examines the processes through which integration becomes a norm in nationality and immigration law and policy at the national and EU levels, and the implications of these processes for the legal status of third country nationals and the overall coherency of the common EU immigration policy.

Book Description
This volume focuses on the rights of minorities. Minorities are often subject to discrimination and individuals find themselves being rejected by the majority. In such cases, people belonging to a minority suffer through hostile situations. Minorities discussed in this book are defined in terms of cultural groups, migrants, displaced persons, sexual minorities (sexual identity). As with the previous volume, readers are informed about the concept of human rights, as an instrument through which civil society tries to eliminate the hostility and suffering of minorities and restores a situation of normality. Minorities must also accept that a democratic society is governed by majority rule and the Rule of Law. The Rights of Minorities: Cultural Groups, Migrants, Displaced Persons and Sexual Identity discusses four types of minorities: cultural groups, migrants, displaced persons, sexual minorities, and policy on minorities. The book is a detailed reference for graduates and scholars in law, human rights activism, political science, sociology and social psychology. The volume is also recommended for working professionals who operate with human rights groups and general readers (non-experts) who want to understand the discourse about human rights in a holistic (moral, legal, social, economic, and political) framework.

Book Description
Human security provides one of the most important protections; a person-centred axis of freedom from fear, from want and to live with dignity. It is surprising given its centrality to the human experience, that its connection with human rights has not yet been explored in a truly systematic way. This important new book addresses that gap in the literature by analysing whether human security might provide the tools for an expansive and integrated interpretation of international human rights. The examination takes a two-part approach. Firstly, it evaluates convergences between human security and all human rights – civil, political, economic, social and cultural – and constructs an investigative framework focused on the human security-human rights synergy. It then goes on to explore its practical application in the thematic cores of violence against women and undocumented migrants in the law and case-law of UN, European, Inter-American and African human rights bodies. It takes both a legal and interdisciplinary approach, recognising that human security and its relationship with human rights cuts across disciplinary boundaries. Innovative and rigorous, this is an important contribution to human rights scholarship.

Book Description

Book Description
Emigrant Dreams, Immigrant Borders: Migrants, Transnational Encounters, and Identity in Spain offers a new approach to the cultural history of contemporary Spain, examining the ways in which Spain’s own self-conceptions are changing and multiplying in response to migrants from Latin America and Africa. In the last twenty-five years, Spain has gone from being a country of net emigration to one in which immigrants make up nearly 12 percent of the population. This rapid growth has made migrants increasingly visible in both mass media and in Spanish visual and literary culture. This book examines the origins of media discourses on immigration and takes the analysis of contemporary Spanish culture as its primary framework, while also drawing insights from sociology and history. Emigrant Dreams, Immigrant Borders introduces readers to a wide range of recent films, journals, novels, photography, paintings, and music to reconsider contemporary Spain through its varied encounters with migrants. It follows the stages of the migrant’s own journey, beginning outside Spanish territory, continuing across the border (either at the barbed-wire fences of Ceuta and Melilla or the waters of the Atlantic or the Strait of Gibraltar), and then considers what happens to migrants after they arrive and settle in Spain. Each chapter analyzes one of these stages in order to illustrate the complexity of contemporary Spanish identity. This examination of Spanish culture shows how Spain is evolving into a new space of imagination, one that can no longer be defined without the migrant—a space in which there is no unified identity but rather a new self-understanding is being born. Vega-Durán both places Spain in a larger European context and draws attention to some of the features that, from a comparative perspective, make the Spanish case interesting and often unique. She argues that Spain cannot be understood today outside the Transatlantic and Mediterranean spaces (both real and imaginary) where Spaniards and migrants meet. Emigrant Dreams, Immigrant Borders offers a timely study of present-day Spain, and makes an original contribution to the vibrant debates about multiculturalism and nation-formation that are taking

Book Description

Book Description
This book focuses on Islamic family law as interpreted and applied by judges in Europe, Australia and North America. It uses court transcriptions and observations to discuss how the most contentious marriage-related issues - consent and age of spouses, dower, polygamy, and divorce - are adjudicated. The solutions proposed by different legal systems are reviewed , and some broader questions are addressed: how Islamic principles are harmonized with norms based on gender equality, how parties bargain strategically in and out of court, and how Muslim diasporas align their Islamic worldview with a Western normative narrative.
