The epoch of representation is as old as the West. Indeed, representation is the West, understood as what at once designates and expands its own limits. But what comes after the West? What comes after representation's disclosure of its own limit? The central problem posed in these essays, collected from over a decade of work, is how in the wake of Western ontologies to conceive the coming, the birth that characterizes being. We are now at the limit of representation, where objects as we experience them have been show to be merely objects of representation--or rather, of presentation, since there is nothing to (re)present. The first part of this book, "Existence," asks how, today, one can give sense of meaning to existence as such, arguing that existence itself, as it comes nude into the world, must now be our "sense." In examining what this birth to presence might be, we should not ask what presence "is"; rather we should conceive presence as presence to someone, including to presence itself. This birth is not the constitution of an identity, but the endless departure of an identity from, and from within, its other, or others. Its coming is not desire but jouissance, the joy of averring oneself to be continually in the state of being born--a rejoicing of birth, a birth of rejoicing. The second section, "Poetry," asks: What art exposes this? In writing, in the voice, in painting? And what if art is exposed to it? How does it inscribe (or rather, "exscribe," in a term the book develops) the coming existence as such? The author's trajectory in this book crosses those of Hegel, Schlegel, Baudelaire, Nietzsche, Freud, and Heidegger, in their comments on art and politics, existence and corporeality, everyday life and its modes of existence and ecstasy. An analysis that dares this crossing involves all the varied accounts of existence, political as well as philosophical, and all the realms of poverty.

"Maurice and I created this guidebook to assist international lawyers and law students seeking to master, or at least to decipher, the Latin recurrently injected into our profession's already arcane argot. It may seem strange that a reference book-sized niche remains in the twenty-first century given the profusion of legal reference works, but the fact remains that recognizing the need for a guidebook like this one is a little uncomfortable. The use of Latin in international legal writing is supposed to appear natural, if not inevitable. We typically pepper our writings with Latin as if the dead language were cayenne in a jambalaya-the more the better. Yet, at some level we are all aware that we often obscure rather than clarify our meaning when we use it instead of plain English. And when we get the Latin right, which we frequently do, and pronounce the words without butchering them beyond all hope of recognition, which we occasionally do, the practice nonetheless tends to baffle law students and even experienced international lawyers unschooled in the vernacular of Cicero. Aspiring international lawyers may wonder about the ubiquity of Latin in international legal discourse in the first place. It may seem that the esoterism of such a prevalent practice can only be intentional. The official explanation is that much early international law was developed by the Roman Empire, and the much admired Roman civil law has found its way by analogy into public international law wherever a lacuna or ambiguity in the principles of international law arose.1 When combined with the fact that Latin was the scholarly lingua franca of most of Europe during international law's early development, international lawyers have inherited an even better-stocked arsenal of Latin phrases and terms than other lawyers"--

This book analyses all relevant questions of State responsibility and attribution arising from the conduct of rebels and governments in the context of civil wars and rebellions aiming at the establishment of a new government or the creation of a new State. Based on a comprehensive analysis of both old and recent State practice, and case law, including investment awards, as well as the works of scholars and the International Law Commission, the book identifies ten basic rules which can be used by States and international tribunals. It explains the history, content and scope of application of the specific solutions adopted in Article 10 of the International Law Commission Articles on State responsibility to address particular problems. The book also critically revisits some of the solutions that have been put forward by tribunals and scholars, and examines a number of questions which have never been addressed by them before.
