It is doubtless true that there are too many law books, but this criticism is not justly directed against a report of adjudged cases. The general principles of law are well settled and the difliculties arise not in the determination of those principles, but in their ap plication to the varying facts and circumstances Of the par ticular case. The practice of the law thus necessitates a con tinual search for precedent. A decision of a nisi prius court may become of great value, especially where the supreme or appellate court has not passed upon the question. It is a well-known fact that many of the most important cases are finally adjudicated, without an appeal, in the lower courts. In many of these cases judges of unquestioned learning and ability have filed carefully prepared Opinions. A few of these opinions have been published in the legal periodicals, but inasmuch as the contents of such periodicals are not di gested, the Opinions are consequently inaccessible.
