Zusammenfassung: This is an open access book. The position of Indonesia and most countries in IMF calculations, facing the same challenges. Each country requires the legal instruments of a good and reliable system of Government to guards against the worst possible economic turmoil. Good governance is an insistence of the constitution in the economic Article 33 paragraph (5), subsequently published Constitution Number: 30 Year of 2014 on Government Administration, contains 17 principles of a good governance. One of the important points of the principle is a government without corruption and manipulation of policy concepts in order to provide access to consolidation in politics and economy. The latest Transparency International report for 2023 shows that Indonesia's corruption perception index was recorded at 34 points on a scale of 0-100 in 2022. This is a 4-point decrease from the previous year. This decline in the CPI also brought down the ranking of Indonesia's CPI globally. It was noted that Indonesia's CPI in 2022 ranked 110th. In the previous year, Indonesia's CPI was ranked 96th globally. Good Governance is all aspects related to the control and supervision of the power of the Government in carrying out its functions through formal and informal institutions. To implement the principles of Good Governance and Clean Government, the Government must implement the principles of accountability and efficient resource management. Good and clean governance will contribute to economic growth and economic growth will have an impact on human development. During the last decades of 20th century, the needs for a good governance has given some impacts and became a recurring theme in literature related to human development. The intervention of government or the quality of government become crucially important in relation to the high achievement of human development. Whereas an effort in improving society's welfare is through economic development. One of dominant aspects in economic development is through legal development. Good law or policy in such country will have some impacts to the existence of good economic growth because supremacy of law is one aspect of a good governance. Law supremacy is an important institution which is related to economic growth because rule of law ensures personal safety, property rights, unbiased contract enforcement, stability of politics, freedom of speech and control of corruption. This is an open access book. Wael B. Hallaq, a renowned sharia scholar, has called sharia an ‘episteme’ that suffered a ‘structural death’ following the dawn of modernity in the nineteenth and early twentieth centuries (Hallaq 2009, 15–16). Yet, its resurgent is remarkable across a number of jurisdictional fault-lines: from Muslim-majority nations in Middle East and Southeast Asia to Muslim-minority societies in Western Europe and North America. Across these jurisdictions, the relationship between sharia and state law is central. It includes sharia-state encounters, notably in the form of (state) Islamic law, in the field of family law, which is often asserted as the ‘core’ or ‘last stronghold’ of sharia (Moors 2003, 2; Coulson 1969, 115–6), and other substantive areas of law, such as Islamic economics and Islamic philanthropy and also jinayah (Islamic penal law). Regardless of their differences in their own specific context, these areas somehow manage to secure an importance place in the modern days. It involves different loci of authority to interpret, legislate, and enforce sharia, or parts of it that not only flourish but also being challenged around the Muslim world. Equally important are implications of the increasingly unsettled authority of apparently agreed-upon substance of sharia. To contribute on these issues, we would like to invite scholars from diverse discipline including law, anthropology, and Islamic studies, working in both Muslim-majority and Muslim-minority contexts, to present their works in our International Seminar on Sharia, Law, and Muslim Society (ISSLaMS).

This edited volume examines the multifaceted impact of the COVID-19 pandemic on peoples and states in East Asia. The book brings together selected case studies in Southeast Asia and the wider East Asian region that analyse how states in the region have responded to the pandemic and its multi-dimensional threats to human security, including risks of atrocity crimes. In the context of protecting human security and upholding the Responsibility to Protect (R2P), the work analyses how such a consequential crisis has compounded socio-economic and political problems, exacerbated societal fault lines, and created new types of risks for people’s safety and security. Using the United Nations Framework of Analysis for Atrocity Crimes: A Tool for Prevention, the book presents seven case studies that identify relevant risks factors confronting selected countries and the extent to which the global pandemic has magnified and/or exacerbated such risks for affected populations. It draws key lessons on how states should manage extant and emerging risks for atrocity crimes and how they can build and enhance their capabilities for preventing atrocities in both conflict-affected and relatively stable states, particularly within the context of Pillar 1 (prevention) and Pillar 2 (capacity building) of the R2P principle. This book examines the potential for regionalization of intellectual property law and policy as a means of improving pharmaceutical access for least developed countries. The challenge of sustainable access to pharmaceuticals continues to be an issue of global significance. While much has been written on emerging economies in this context, least developed countries have been largely overlooked. This book fills this gap by taking the East African Community as a case study of developing and least developed countries to illustrate why and how a regional collective approach is preferred. It adopts a holistic approach in finding sustainable solutions to both IP and non-IP barriers to pharmaceutical access across a range of inter-related issues through a regional cooperative scheme. It evaluates factors that are necessary for successful regional cooperation, such as legal and policy coherence, WTO rule compliance, the threat of protectionism, regional competition rules, and so on, in order to produce relevant legal and policy recommendations to both existing and intending regional coalitions desiring to improve pharmaceutical access. It also looks beyond the scope of IP barriers to pharmaceutical access, examining non-IP-related factors such as pharmaceutical market intelligence, local pharmaceutical manufacturing capacity, economies of scale and purchasing power, medical regulation and quality assurance, technology transfer, and market size amongst others.
