In addition, we are establishing equipment requirements for agents. The Department's enhanced inspection, investigation, and enforcement procedures were previously established through notice and comment rulemaking and thoroughly address the hazardous material transportation matters identified by Congress. This final rule is required to codify changes to Federal hazardous materials transportation law and to ensure transparency and consistency for hazardous materials inspectors across all modes of transportation. As it affects only agency enforcement procedures, there are no additional compliance costs to industry associated with this final rule. Updated as of May 29, 2018 PHMSA proposes to revise the Federal pipeline safety regulations to address human factors and other components of control room management. The proposed rules would require operators of hazardous liquid pipelines, gas pipelines, and liquefied natural gas (LNG) facilities to amend their existing written operations and maintenance procedures, operator qualification (OQ) programs, and emergency plans to assure controllers and control room management practices and procedures used maintain pipeline safety and integrity. This proposed rule results from a PHMSA study of controllers and controller performance issues known as the Controller Certification Project (CCERT), a National Transportation Safety Board study, safety-related condition reports, operator visits and inspections, and inquiries. This rule would improve opportunities to reduce risk through more effective control of pipelines and require the human factors management plan mandated by the Pipeline Inspection, Protection, Enforcement, and Safety Act of 2006 (PIPES Act). These regulations would enhance pipeline safety by coupling strengthened control room management, including automated control systems, with improved controller training and qualifications and fatigue management. PHMSA expects these regulations will complement efforts already underway in the pipeline industry to address human factors and control room management, such as the development of new national consensus standards, including an American Petroleum Institute (API) recommended practices on roles and responsibilities, shift operations, management of change, fatigue management, alarm management and SCADA display standard, as well as comparable business practices at some pipeline companies. Pursuant to a congressional request, GAO evaluated the: (1) effectiveness of the Federal Railroad Administration's (FRA) hazardous materials inspection program; and (2) extent to which the Department of Transportation's (DOT) Research and Special Programs Administration (RSPA) improved its Hazardous Materials Information System (HMIS) and established a program to register hazardous materials shippers. GAO found that: (1) FRA inspectors' hazardous materials enforcement manual included outdated and contradictory inspection goals and guidance, did not describe ways for inspectors to identify and target high-risk shippers, and did not clearly delineate when inspectors should cite shippers and railroads for noncompliance or inspectors' authority to issue violations at shippers' facilities; (2) FRA did not use information available from its sources or HMIS to target inspection resources at high-risk shippers and railroad facilities; (3) FRA inspectors generally focused on inspecting individual cars carrying hazardous materials, rather than reviewing the adequacy of shippers' or railroads' safety procedures; (4) FRA lacked adequate staffing to accomplish its objective of ensuring that shippers and railroads complied with RSPA regulations; (5) FRA cited budget restrictions as the primary reason for not actively seeking to fill six position vacancies or adding more positions; (6) FRA has not sought statutory authority to certify state inspectors to participate in its hazardous materials inspection program, although some states have adopted federal standards and shown an interest in assisting FRA; (7) HMIS did not include data about 23 of 96 railroad hazardous materials releases GAO reviewed; and (8) RSPA did not require shippers to submit reports of hazardous materials releases, require post-investigation report updates, share accident and enforcement data with other agencies, or require major hazardous materials shippers to register.

Resilient supply chains are crucial to maintaining the consistent delivery of goods and services to the American people. The modern economy has made supply chains more interconnected than ever, while also expanding both their range and fragility. In the third quarter of 2017, Hurricanes Harvey, Irma and Maria revealed some significant vulnerabilities in the national and regional supply chains of Texas, Florida, the U.S. Virgin Islands, and Puerto Rico. The broad impacts and quick succession of these three hurricanes also shed light on the effectiveness of the nation's disaster logistics efforts during response through recovery. Drawing on lessons learned during the 2017 hurricanes, this report explores future strategies to improve supply chain management in disaster situations. This report makes recommendations to strengthen the roles of continuity planning, partnerships between civic leaders with small businesses, and infrastructure investment to ensure that essential supply chains will remain operational in the next major disaster. Focusing on the supply chains food, fuel, water, pharmaceutical, and medical supplies, the recommendations of this report will assist the Federal Emergency Management Agency as well as state and local officials, private sector decision makers, civic leaders, and others who can help ensure that supply chains remain robust and resilient in the face of natural disasters.
