Die Bearbeitung geschichtlicher Themen ist in vielerlei Hinsicht schwierig. Zum einen ist eine Beschrankung erforderlich zum anderen soll ein moglichst breiter Uberblick gegeben sowie eine Struktur geschaffen werden. Fur die japanische Rechtsgeschichte ergibt sich das Problem, dass Japan erst 1872 den gregorianischen Kalender ubernommen hat, so dass die davor stattgefundene Jahreszahlung Fehler aufweisen kann. Daher erfolgt in aller Regel in wissenschaftlichen Abhandlungen eine systematische Aufstellung nach kaiserlichen Arabezeichnungen oder die Aufteilung in drei groe Zeitabschnitte: Altzeit, Mittlere Zeit und Neuere Zeit. Die Perioden kann man wie folgt einteilen: Vor- und Fruhgeschichte (genshi) 250 v. Chr. bis ca. 710 n. Chr., Altertum (kodai) ca. 300 (710) - 1192; (Mittelalter) 1192 - 1568, Fruhmoderne Geschichte (kinsei) 1573 - 1867, Moderne (kindai) bis 1945 und Zeitgeschichte (gendai) seit 1945. Dennoch werden in dieser Arbeit Jahreszahlen angegeben, damit eine ungefahre Einordnung auch in die europaische Rechtsgeschichte moglich ist. Japan hat durch seinen Inselstatus und die dadurch gegebene Isolation lange Zeit weder eine besondere Zivilisation oder Weltreligion gehabt. Das Herkommen des japanischen Volkes ist noch weitgehend ungeklart, ist aber fur die Rechtsgeschichte von nicht als zu groer Bedeutung. Obwohl in der heutigen Zeit Japan sehr viele Rechtsnormen aus Westeuropa ubernommen hat, ist es sinnvoll auch sehr alte Rechtsstrukturen zu betrachten, um das heutige Recht und Rechtsverstandnis in Japan besser nachvollziehen zu konnen.
