The celebratory tone about the emergence of the BRICs and the improved growth in Sub Saharan Africa and Latin America during the 2000s obscures the reality that, for large parts of the developing world, the development challenges are more acute than ever before. After three decades of Washington Consensus policies, deepening globalization, and China's and India's increasing competitiveness in ever more goods and services, many developing countries are now facing three critical challenges: how to engender a transformation of the production structure that creates many more productive jobs, how to make growth more inclusive, and how to stimulate a growth process compatible with environmental sustainability. This book brings together development scholars and practitioners from multiple academic disciplines and policy perspectives to analyze important facets of this triple challenge, to explore interconnections among them and suggest strategies for overcoming the challenges in the current age of globalization. Three features distinguish this book from other current works in the field. First, this book looks beyond the current global crisis and short-term growth opportunities and analyzes the challenges to development from a long-term perspective. Second, books on the barriers to development tend to concentrate on one of the three challenges, e.g. Barbier (2010) A Global Green New Deal on environmental sustainability; Cimoli, Dosi, Stiglitz (2009) Industrial Policy and Development on structural transformation; and Milanovic (2011) The Have and the Have-Nots on exclusion. This book, in contrast, brings the three challenges together to emphasize that they challenges are interlinked and that strategies and policies must begin to recognize these interconnections to address different aspects of the challenges concomitantly. Finally, the contributors to the book include some of the most renowned development thinkers of our time.

The chapters in this volume are based on the papers that were presented at the Calcutta seminar organized in March 1992 by the ILA Committee on Lehal Aspects of a New International Economic Order (NIEO). The conference focused on the right to development, in particular its ideas and ideology, human rights aspects and implementation in specific areas of international law. The volume is accordingly organized in three parts. The chapters cover a vast area of subjects, derived from the UN Declaration of the Right to Development. From the developed and underdeveloped world 33 authors discuss topics including: contents, scope and implementation of the right to development; human rights of individuals and peoples; co-operation between the European Community and the Lomé IV states; current developments in investments treaties; refugee protection; development and democracy; concept of sustainable development; environmental issues; protection of intellectual property; transfer of technology; human rights in international financial institutions; and the legal conceptualization of the debt crisis. Professor Oscar Schachter observes in the first chapter that the Declaration continues to be a `challenging subject for legal commentary' for its `detable legal status, its combination of collective and individual rights, its expansive conception of development and its equivocal obligation'. "Transfer of Development Rights" (TDR) programs allow local governments to put economic principles to work in encouraging good land use planning. TDR programs most often permit landowners to forfeit development rights in areas targeted for preservation and then sell those development rights to buyers who want to increase the density of development in areas designated as growth areas by local authorities. Although TDR programs must conform to zoning laws, they provide market incentives that make them more equitable (and often more lucrative) for sellers and frequently benefit buyers by allowing them to receive prior approval for their high-density development plans. Since the 1970s when modern TDR applications were first conceived, more than 200 communities in 33 states across the U.S. have implemented TDR-based programs. The most common uses of TDR to date involve protecting farmland, environmentally sensitive land, historic sites, and "rural character," and urban revitalization. Until now, however, there has never been a clearly written, one-volume book on the subject. At last, The TDR Handbook provides a comprehensive guide to every aspect of TDR programs, from the thinking behind them to the nuts and bolts of implementation-including statutory guidance, model ordinances, suggestions for program administration, and comparisons with other types of preservation programs. In addition, six of its twenty chapters are devoted to case studies of all major uses to which TDR programs have been utilized to date, including recent urban revitalization projects that utilize TDR principles.
