Book Description
The archives of many television broadcasters now contain material which includes more than half a century of contemporary, documentary and entertainment history and are of immense cultural and economic value. Digitisation has created an entirely new technical basis for making these assets available to a wide audience, and there are a whole range of projects aimed at opening up audiovisual archives (including those of broadcasters). Examples that might be mentioned are the BBC Creative Archive, the Dutch Filmotech initiative or the French Inamâdiapro database. However, many projects that open up broadcasters' archives and exploit them online, generally run up against serious problems when it comes to clearing the rights for these archived works. These problems arise, firstly, due to a contractual practice that developed in the pre-digital era and to aspects of copyright law that do not really meet the needs of the digital age. Secondly, the very large number of works stored in archives constitutes a challenge that is not easily overcome. The aim of this IRIS Special publication is to discuss the subject of "Digitisation and online exploitation of broadcasters' archives" from a number of different perspectives. The team of authors involved is accordingly made up of representatives of many different interests: copyright holders and those who look after their interests, television broadcasters, lawyers and copyright experts. This IRIS Special thus not only provides you with legal guidance but is at the same time a field report written by specialists who are facing the challenge of opening up broadcasters' archives to a wide audience. By working out existing problems that have hitherto not been satisfactorily resolved, both policy-makers and legislators are shown where immediate action is needed.
Getting Broadcaster Archives Online

Book Description
This paper explores why copyright clearance issues currently hinder Australian public broadcasters from putting their program archives online, at a time when broadband offers new opportunities for public access. The difficulty of putting program archives online is an example of copyright “gridlock” preventing access to valuable cultural material. The paper includes case studies of the BBC and NHK Japan who have conducted pilot online archive projects. The article concludes that the current copyright regime - which is based on an “opt-in” model of individual permissions of all rights-holders, will not facilitate online access to public broadcaster archives on any comprehensive scale. It briefly considers how such access might be achieved if new compulsory statutory licensing schemes or “opt-out” models such as the Google Books Settlement are adopted.

Public Service Broadcasting 3.0
Author: Mira Burri
Publisher: Routledge
ISBN: 1317664787
Category : Law
Languages : en
Pages : 306
Book Description
The digital media environment is characterized by an abundance and diversity of content, a multiplicity of platforms, new modes of content production, distribution and access, and changed patterns of consumer and business behaviour. This has challenged the traditional model of public service broadcasting (PSB) in diverse ways. This book explores whether and how PSB should adapt to reflect the conditions of the digital media space so that it can effectively and efficiently continue to serve its public mandate. Drawing on literature on media governance in media and communication science, public international law as well as discussions on cyberlaw, Mira Burri maps and critically analyses existing policy and scholarly debates on PSB transformation. She challenges some of conventional rationales for reform, identifies new ones, as well as exposes the limitations placed upon existing and future policy solutions by global media governance arrangements, especially in the fields of trade, copyright and Internet governance. The book goes on to advance a future-oriented model of Public Service Media, which is capable of matching an environment of technological and of governance complexity. As a work that explores how public interest objectives can be pursued efficiently and sustainably in the digital media ecology, this book will be of great interest and use to students and researchers in media law, information technology law, and broadcast media studies, as well as to policy-makers.
