In the past three decades, the most advanced forms of illicit trade have broken with all historical precedents and, as Dark Commerce shows, now operate as if on steroids, tied to computers and social media. In this new world of illicit commerce, which benefits states and diverse participants, trade is impersonal and anonymized, and vast profits are made in short periods with limited accountability to sellers, intermediaries, and purchasers. Focusing on the experiences of Thailand and Australia, this book examines the impact of trade-restrictive measures as related to the EU’s regulations to prevent Illegal, Unreported and Unregulated (IUU) fishing. It is widely accepted that IUU fishing is harmful, and should be stopped, but there are different approaches to tackling it. Acknowledging this, this book argues that major efforts to fight IUU fishing require careful analyses if the goal is to achieve optimal results and avoid unintended consequences. The book draws on the recent experiences of Thailand and Australia to offer an empirical examination of one increasingly prominent solution, trade-restrictive measures. With Thailand representing direct, active intervention by the EU and Australia a more indirect dispersion of policy narratives and discourses, the book provides a rounded view on how likely it is that different countries in different situations will adapt to the changing policy norms regarding IUU fishing. Understanding the reactions of countries who might be targeted, or otherwise be influenced by the policy, generates new knowledge that helps inform a more effective and scalable implementation of the policy on the part of the EU and a better governance preparedness on the part of non-EU fishing nations. In broader terms, this book exposes a key moment of change in the compatibility between environmental regulations and international trade. The EU IUU policy is a prime example of a policy that uses the mechanisms of international trade to account for environmental and conservation objectives. By way of the unilateral and trade-restrictive stance against IUU fishing, the EU has positioned itself as a major market and normative power, driving its sustainability norms outwards. This book sheds light on the efficacy of this policy setup based on the analysis of country perspectives, which is a key factor influencing its potential spread. This book pulls literature together to examine the quality of climate governance based in the experience of Global South regions—Africa, Latin America, and Caribbean. While these regions are resilient, the IPCC 2022 Report indicates that the effects of climate change are crippling their thinly structured governance systems and limited capacities. For example, in addition to environmental devastation, loss of life, and livelihoods, these regions have endured most of the “loss and damage” due to climate change impacts. How are they responding? What are the outcomes? And where do they go from here? Given this background, the book’s goal is to question assumptions about climate governance patterns, systems, institutions, and processes in these regions, using comparative analytical techniques while distilling information about policy outcomes that other approaches do not provide. It argues that these regions and individual countries within them have a lot to learn from and about each other rather than look to the Global North and wealthy countries for economic, political, and administrative models that hardly match their lived experience and ontological outlooks. In doing so, it aspires to promote a fruitful South-South policy-related dialogue via scholarly exchanges and also contribute to advance the study and practice of international and comparative public administration. This book explores violence against the environment within the broad scope of transnational environmental crime (TEC): its extent, perpetrators, and responses. TEC has become one of the greatest threats to environmental and human security today, as well as a lucrative enterprise and a mode of life in many regions of the world. Transnational Spheres of Ecoviolence argues that we cannot seriously consider stopping TEC without also promoting environmental (and climate) justice. The spheres covered range from wildlife and plant crime to illegal fisheries to toxic waste and climate crime. These acts of violence against the environment are both localized in terms of event and impact, and globalized in terms of market drivers and internationalized responses. Because it is so often intimately linked to political violence, coerced labor, economic and physical displacement, and development opportunity costs, ecoviolence must be viewed primarily as a human security issue; the fight against it must derive legitimacy from impacts on local communities, and be twinned wth the protection of environmental activists. Reliance on the generosity of distant corporations or the effectiveness of legal structures will not be adequate; and militarized responses may do more harm to human security than good to nature. A transformative approach to transnational ecoviolence is a very complex task affected by the geopolitics of neoliberalism, authoritarian states, rebel factions and extremists, socio-economic patterns, and many other factors. In this challenging text, the authors capture this complexity in digestible form and offer a wide-ranging discussion of commensurate policy recommendations for governments and the general public.
