Since the 1980s, industrial relations and labor law in Israel have rapidly changed from a European style of corporatism to a model of pluralism familiar to North America. The country's legal and industrial relations systems have become more decentralized, yet more intensively regulated; they are no longer centrally managed, but they do not fit the neoliberal model of a free market. In recent years, a dynamic system for voicing interests has evolved, granting more leeway to individuals, identity-based representation, and a flourishing civil society, but restraining effective collective representation. In Fading Corporatism, Guy Mundlak explains the changing nature of labor law and industrial relations in Israel and the seemingly paradoxical outcomes of transformation as played out in numerous spheres, including the law governing the recognition of trade unions and strikes; the emergence of a human rights regime; and the regulation of temporary work agencies, Palestinian workers from the occupied territories, and migrant workers. Placing the example of Israel in a conceptual framework that draws on the literature of corporatism, Mundlak offers a theoretical coupling of legal studies and industrial relations that will interest scholars and practitioners in both fields. Why has the Egyptian state, which is more repressive and authoritarian than its Mexican counterpart been unable to overcome the opposition of a labor movement, that is smaller, less organized, and more repressed than the Mexican labor movement? Through agitation or the threat of agitation, Egyptian workers have been able to hinder the reform process, while the Mexican labor movement, which is larger and better organized was unable to resist privatization. The Egyptian state's low capacity and isolation is best understood by looking at the founding moment -- or incorporation period of each regime. The critical distinction between Mexican and Egyptian incorporation is that in Egypt, the labor movement was depoliticized and attached to the state bureaucracy, while in Mexico, workers were electorally mobilized into a political party. This difference would prove crucial during the reform process, because, social control in Mexico, exercised through the PRI, was more effective in coopting opponents and mobilizing urban constituencies for privatization than the control mechanisms of the Egyptian state bureaucracy.

Using a comprehensive analysis of the wave of organizing that swept the country starting in 2007, Labor in Israel investigates the changing political status of organized labor in the context of changes to Israel’s political economy, including liberalization, the rise of non-union labor organizations, the influx of migrant labor, and Israel’s complex relations with the Palestinians. Through his discussion of organized labor’s relationship to the political community and its nationalist political role, Preminger demonstrates that organized labor has lost the powerful status it enjoyed for much of Israel’s history. Despite the weakening of trade unions and the Histadrut, however, he shows the ways in which the fragmentation of labor representation has created opportunities for those previously excluded from the labor movement regime. Organized labor is now trying to renegotiate its place in contemporary Israel, a society that no longer accepts labor’s longstanding claim to be the representative of the people. As such, Preminger concludes that organized labor in Israel is in a transitional and unsettled phase in which new marginal initiatives, new organizations, and new alliances that have blurred the boundaries of the sphere of labor have not yet consolidated into clear structures of representation or accepted patterns of political interaction.
