Thurgood Marshall became a living icon of civil rights when he argued Brown v. Board of Education before the Supreme Court in 1954. Six years later, he was at a crossroads. In Kenya, Marshall could become something that had not existed in his own country: a black man helping to found a nation. He became friends with Kenyan leaders Tom Mboya and Jomo Kenyatta, serving as advisor to the Kenyans, who needed to demonstrate to Great Britain and to the world that they would treat minority races (whites and Asians) fairly once Africans took power. He crafted a bill of rights, aiding constitutional negotiations that helped enable peaceful regime change, rather than violent resistance. Marshall's involvement with Kenya's foundation affirmed his faith in law, while also forcing him to understand how the struggle for justice could be compromised by the imperatives of sovereignty. Religious freedom is widely recognized today as a basic human right, guaranteed by nearly all national constitutions. Exporting Freedom charts the rise of religious freedom as an ideal firmly enshrined in international law and shows how America’s promotion of the cause of individuals worldwide to freely practice their faith advanced its ascent as a global power. Anna Su traces America’s exportation of religious freedom in various laws and policies enacted over the course of the twentieth century, in diverse locations and under a variety of historical circumstances. Influenced by growing religious tolerance at home and inspired by a belief in the United States’ obligation to protect the persecuted beyond its borders, American officials drafted constitutions as part of military occupations—in the Philippines after the Spanish-American War, in Japan following World War II, and in Iraq after 2003. They also spearheaded efforts to reform the international legal order by pursuing Wilsonian principles in the League of Nations, drafting the United Nations Charter, and signing the Helsinki Accords during the Cold War. The fruits of these labors are evident in the religious freedom provisions in international legal instruments, regional human rights conventions, and national constitutions. If illicit drug trafficking is a global problem, why won't other nations comply with the drug control agenda of the United States? NarcoDiplomacy departs from traditional responses to this question, which have held that compliance with the American agenda has been beyond the capacity of key countries. By focusing on Germany and Japan, touted as two of the strongest allies of the United States in drug control efforts, H. Richard Friman exposes the flaws in capacity arguments and the policies based on them. Drawing on sources ranging from previously unknown Imperial German archives to interviews with policy makers and law enforcement officials, Friman offers a thorough analysis of bilateral and multilateral relations. He traces their evolution from international opium control efforts of the early 1900s through disputes over cocaine and money laundering during the Reagan and Bush antidrug campaigns. His work reveals that, although the internal logic of the U.S. posture was sound, American policy makers failed to recognize the nature of German and Japanese cooperation and defection, or to identify which aspects of capacity were at issue. The resulting policy, Friman contends, actually undermined German and Japanese compliance with the American agenda. Extending this analysis to Latin America, NarcoDiplomacy explores the ramifications of Friman's findings for the future of U.S. drug control policy.
