Federal government agencies provide about $33 billion a year to universities to conduct scientific research. That continuing investment expands human knowledge and helps educate the next generation of science and technology leaders. New discoveries from university research also form the basis for many new products and processes that benefit the nation and its citizens. In fact, in the knowledge economy, technological innovation and the scientific research on which it is based are critical for much of the nation's productivity growth. New products and processes do not spring fully formed from the basic research performed at universities. They require not only discoveries or good ideas but also further development, capital, manufacturing capability, and marketing. Universities and other organizations use the process of technology transfer to move scientific findings to the private sector for further development and commercialization. The human capital aspect of technology transfer is often undervalued, but students and faculty are usually the most effective means of translating research discoveries into new technologies. Many of the most successful university-industry interactions are based on the education and training of students who have the knowledge and skills to meet industry needs, or on relationships that faculty members have developed with particular companies. This document provides basic information on university technology transfer. It describes how it works and how the public benefits from it. A brief description of the Bayh-Dole Act and an explanation of its success are also presented. Finally, how royalties are used by the universities from licensed technologies is described.

University technology transfer activities have become increasingly important as a source of information dissemination and revenue since the passage of the Bayh-Dole Act in 1980. A two-equation recursive model and technology transfer data from the Statistics Access for Tech Transfer (STATT) published by the Association of Technology Managers (AUTM) for the years 2008-2012, North America's High-Tech Economy: The Geography of Knowledge-Based Industries published by the Milken Institute based on the year 2007, A Data-Based Assessment of Research-Doctorate Programs in the United States by the National Research Council based on the academic year 2005-2006, and university intellectual property policies are used to explain variation in technology disclosures and outputs from technology transfer efforts across 86 U.S. research universities. Technology transfer outputs include the number of licenses executed, licenses generating income, cumulative active licenses, and licensing income. The following factors enhance university technology disclosures: high quality faculty, technology transfer office staff size, and research expenditures. This study also found that technology disclosures are not positively related to revenue sharing incentives to university scientists. The results suggest that technology transfer outputs are significantly related to number of technology disclosures.

This dissertation seeks to identify possible factors that might explain the relative success or lack of success of efforts to commercialize university-owned inventions. The analytic framework for this study is based on an entrepreneurial theory that claims that there is no best way to manage an organization, the optimal course is contingent upon the internal structure and the external situation. A review of the relevant literature shows that there has been a continuous effort to assess internal factors such as university reputation and university initiatives or how external factors such as government policy and local geography could affect technology transfer. Despite relevance, however, no empirical studies have examined the joint impact that internal and external factors might have on technology transfer. This dissertation makes an original contribution to the literature through empirical research on the joint effect of internal and external factors on technology transfer. After providing an overview of the Bayh-Dole Act and its effects on technology transfer within the U.S. universities, the institutional context of technology transfer in China including market-oriented reforms in the public and private sector in China, and PRC law governing technology transfer are considered. An empirical study of technology transfer activities of 111 Chinese universities using a multi-level regression model is used to assess the internal and external factors that influence technology transfer in China. It argues that the Bayh Dole Act vastly underestimated the difficulty in licensing advances made within universities. First, these developments are often far upstream. Second, university technology transfer officers do not have the capacity to successfully build fruitful industrial relations across the entire spectrum of technological fields where research in their universities is conducted.
