With the Treaty of Lisbon, national Parliaments obtained a direct role in the legislative process of the European Union (EU). When the Commission releases a legislative proposal, each national Parliament has eight weeks to issue a Reasoned Opinion stating that the draft violates the EU principle of subsidiarity if they wish to do so. This article provides context on this so-called Early Warning System (EWS), and then studies empirically when national Parliaments issue Reasoned Opinions under the EWS. A within-between panel regression covering all 28 EU countries for 2010-16 leads to novel findings on the issuance of Reasoned Opinions. In particular, there is no robust statistical evidence that variations in public attitudinal euroscepticism in a country affect the number of Reasoned Opinions issued by its Parliament. In contrast, electoral euroscepticism as measured by the election of eurosceptic Parliaments is found to have a strongly significant across-country effect on the number of Reasoned Opinions.

Why Noncompliance traces the history of noncompliance within the European Union (EU), focusing on which states continuously do or do not follow EU Law, why, and how that affects the governance in the EU and beyond. In exploring the EU's long and varied history of noncompliance, Tanja A. Börzel takes a close look at the diverse groups of noncompliant states throughout the EU's existence. Why do states that are vocally critical of the EU have a better record of compliance than those that support the EU? Why has noncompliance been declining since the 1990s, even though the EU was adding member-states and numerous laws? Börzel debunks conventional wisdoms in EU compliance research, showing that noncompliance in the EU is not caused by the new Central and Eastern European member states, nor by the Eurosceptic member states. So why do these states take the brunt of Europe's misplaced ire? In today’s Europe, deep cracks are showing in the system of political cooperation that was designed to prevent the geopolitical catastrophes that ravaged the continent in the first half of the twentieth century. Europeans are haunted, once again, by the specters of nationalism, fascism, and economic protectionism. Instead of sounding the alarm, many conservatives have become cheerleaders for the demise of the European Union (EU). This compelling book represents the first systematic attempt to justify the European project from a free-market, conservative viewpoint. Although many of their criticisms are justified, Dalibor Rohac contends that Euroskeptics are playing a dangerous game. Their rejection of European integration places them in the unsavory company of nationalists, left-wing radicals, and Putin apologists. Their defense of the nation-state against Brussels, furthermore, is ahistorical. He convincingly shows that the flourishing of democracy and free markets in Europe has gone hand in hand with the integration project. Europe’s pre-EU past, in contrast, was marked by a series of geopolitical calamities. When British voters make their decision in June, they should remember that while Brexit would not be a political or economic disaster for the United Kingdom, it would not solve any of the problems that the “Leavers” associate with EU membership.
