(Uncorrected OCR) Abstract An environmental impact assessment (EIA) system has been established in China and Hong Kong for 24 years. It has made a major contribution to the environmental management in these two places and a comparative study has been undertaken. Though the EIA systems were established almost at the same time in these two places, Hong Kong has developed a more comprehensive and effective system in dealing with potential adverse impacts of development projects and in handling the uncertainties associated with EIA. The legal basis, institutional structure and performance of Hong Kong's EIA system appear better than that of the mainland. In contemporary mainland China, environmental problems constrain the country's development and thus, central government should put more effort on the enhancement and strengthening of the EIA system so as to achieve sustainable development for the country. 1.

Abstract: Abstract of this thesis entitled An Evaluation of the Effectiveness of Environmental Impact Assessment in Hong Kong with Special Reference to Ecological Impacts Submitted by Leung Cheuk Nga for the degree of Master of Philosophy at The University of Hong Kong in September 2003 The Environmental Impact Assessment (EIA) process in Hong Kong changed from its administrative basis to a statutory requirement in 1998. This evolving EIA system serves the purposes of providing an additional safeguard to our ecosystem, yet it has been mirrored by concerns about its effectiveness. This thesis attempts to evaluate its effectiveness through reviewing EIA reports, interviewing various stakeholders and a case study at Kam Tin in northwest Hong Kong. Thirty-four EIA reports submitted after the enactment of EIA Ordinance are reviewed. In general, the reports adequately describe the development projects and the existing areas, and provide a comprehensive list of species groups and habitats being potentially affected. However, many reports do not present the details of survey timing and efforts, hence, the validity of the above information cannot be verified. In addition, impact prediction should have been supported by empirical evidence and quantitative analysis. There are opinions that various stakeholders fail to enable the fairly instituted EIA system to function in its most effective way. EIAs can be improved through enhancement of the consultant appointment mechanism and the tendering system for EIA studies, introduction of accreditation scheme for consultants, and more informed and objective review of survey methodology and timing presented in Study Brief. Ultimately, successful implementation requires true and fair EIA reports and dynamic public consultation processes. Furthermore, consideration of cumulative environmental impacts is another important aspect in EIA to be explored. These impacts are usually underestimated in many project-based EIA studies, partly due to the difficulties in anticipating and predicting the response of wildlife and human (landlords/land manager etc), in terms of habitat loss, disturbance and fragmentation. A case study through evaluation of the cumulative impacts from a total of four major linear infrastructure projects over the past ten years at Kam Tin valley in northwest Hong Kong is carried out. These impacts can be visualized by applying some Geographical Information System (GIS) techniques to present their geographical relationships between the related development projects and the affected egretries. The results clearly demonstrate that the largely neglected cumulative impacts, though insignificant individually, could collectively assert severe negative effects on the system. To use EIA as a effective planning tool is a great challenge to all other stakeholders involved. Overcoming those teething problems identified in this study and incorporating Strategic Environmental Assessment (SEA) into the planning system will be a major step towards maintaining environmentally sustainability.
