It has been re marked recently by Dr. Delamater, who has been on the witness stand as Often as any living physician, - having served in that capacity over fifty years, - that Mr. Elwell's hypothetical questions to the medical witness are completely balanced, and perfectly framed, and better calculated to bring out Of the witness just the exact scientific fact or point he is after, than those Of any other attorney he has ever had examine him. It is a serious truth that intelligent lawyers experience the greatest difficulty in examining the medical witnesses - not being familiar with the deep and difficult questions of our science, it is impossible that they should be able to correctly shape their questions, or understand the exact bearing Of the answers, except in the plainest cases. Much had blood is thus produced between the witness and counsel - they do not and cannot understand each other. It has been truly said by a distinguished lawyer referred to in these pages, speaking Of this difficulty The witness does not know what the lawyer desires to prove and the lawyer does not know what he desires to prove himself. Truth and jus tice may sometimes prevail notwithstanding, but instead of this being a trial, it is a mere game Of chance, in which folly throws the dice and the gallows attends the sequel. Excerpt from Medical Jurisprudence Perhaps the early demand for a new American edition of Taylor's classical medical jurisprudence may in some measure be attrib ntable to the new features added at the time of the preceding Ameri can revision. The work was then brought thoroughly to date, and the law and judicial decisions both in Great Britain and the United States were introduced, together with a tabulation of cases and a reference to authorities. These changes made the work more serviceable to all classes in the two professions which it joins, increasing its hold as a favorite text-book in schools of medicine and law, rendering it even more useful to physicians in practice, and lawyers in the preparation of briefs and confirming its previous acceptance as an authority, by all English-speaking judicial tribunals. Since the issuance of the previous edition a strong impulse has been given to Forensic Medicine, by the International Congress of Medical Jurisprudence, by the Congress of Medical Jurisprudence of New York, 1895, and also by the special development of medico-legal Surgery in various societies. The present time, therefore, is most auspicious for the appearance of this new edit-ion, and it is fortunate that the demand for it comes at a time when these important advances can be represented. The increasing frequency of damage cases renders this department of medico-legal Surgery of growing importance. The eleventh American edition included the admirable work with which Dr. Thomas Stevenson had enriched the twelfth English edi tion, and was a thorough revision of all previous American and Eng lish editions.
