Tras fracasar la negociación entre los sindicatos y las asociaciones empresariales, el Gobierno ha dictado el Real Decreto-ley 7/2011, de 10 de junio, de medidas urgentes para la reforma de la negociación colectiva. La norma está en vigor desde el 12 de junio de 2011. En el presente libro y desde una perspectiva eminentemente práctica, especialistas en la materia analizan las medidas introducidas por el Real Decreto-ley, entre las que se encuentran las siguientes: se refuerzan los convenios colectivos sectoriales de ámbito estatal y autonómico, en detrimento del ámbito provincial y, a la vez y salvo que aquellos convenios estatales y autonómicos dispongan lo contrario, se establece la prioridad aplicativa de los convenios colectivos de empresa y de grupo de empresas en determinadas materias, como son, entre otras, la determinación de la cuantía salarial y del tiempo de trabajo; se prevé un plazo mínimo para la denuncia del convenio y unos plazos máximos para el inicio y para la negociación (de ocho a catorce meses) de un nuevo convenio colectivo; se potencian los procedimientos de solución no judicial de los conflictos laborales, especialmente el arbitraje; se refuerza el papel de la comisión paritaria de los convenios colectivos; se tratan de facilitar medidas de «flexibilidad interna negociada»; se introduce una nueva regulación de la llamada ultraactividad de los convenios colectivos que han agotado su duración prevista, si bien, en defecto de acuerdo y de sometimiento a los procedimientos de solución no judicial, se mantiene la vigencia del convenio colectivo; se refuerza el papel de la secciones sindicales frente a los comités de empresa, y, en fin, se regula expresamente, por primera vez, la legitimación para negociar convenios colectivos de grupos de empresa y de las llamadas «empresas en red». En definitiva, se trata de una práctica monografía muy útil para todos los profesionales que participan e intervienen en las relaciones laborales.
