The Bill will give effect to the Government's proposals for the reform of the regulatory framework for the communications sector (as set out in the White Paper - "A New Future for Communications"; Cm 5010). The main provisions are: the transfer of regulatory functions to a new body, the Office of Communications (OFCOM); the replacement of the current system of licensing telecommunications systems; the power to develop a new mechanism to enable spectrum to be traded; the development of the current system for regulating broadcasting - both to rationalise the regulation of public service broadcasters and accommodate the switchover to digital broadcasting; the establishment of a consumer panel to advise OFCOM; the establishment of a content board to advise OFCOM in relation to the content of anything broadcast. In February 2002 the European Parliament and the Council of Ministers adopted four directives on a common regulatory framework for electronic communications. Provisions in this Bill implement these regulations in the UK.

The Joint Committee finds that draft Bill must be significantly amended to deliver only necessary data that law enforcement needs, and the Home Secretary should not be given carte blanche to order retention of any type of data. Whilst calling for a narrower focus, the Committee recognises that more needs to be done to provide law enforcement and other agencies access to data they cannot currently obtain and so makes a range of constructive proposals to enable the Home Office to present a better Bill to Parliament. There must also be much better consultation with industry, technical experts, civil liberties groups, public authorities and law enforcement bodies before a new Bill is introduced.
