Ruins and remnants of the past are endowed with life, rather than mere relics handed down from previous generations. Living Ruins explores some of the ways Indigenous people relate to the material remains of human activity and provides an informed and critical stance that nuances and contests institutionalized patrimonialization discourse on vestiges of the past in present landscapes. Ten case studies from the Maya region, Amazonia, and the Andes detail and contextualize narratives, rituals, and a range of practices and attitudes toward different kinds of vestiges. The chapters engage with recently debated issues such as regimes of historicity and knowledge, cultural landscapes, conceptions of personhood and ancestrality, artifacts, and materiality. They focus on Indigenous perspectives rather than mainstream narratives such as those mediated by UNESCO, Hollywood, travel agents, and sometimes even academics. O Brasil, cujo território ostenta dimensões continentais, dotado de diversos biomas, alguns dos quais são garantia da estabilidade climática no continente sul-americano, e até mesmo no planeta, detém relevância crucial quando se trata do meio ambiente. Decisões equivocadas do legislador pátrio e respectivas ações decorrentes podem significar danos ambientais irreparáveis, razão pela qual a legislação ambiental deve sempre primar pela defesa do meio ambiente. A realização de Avalição de Impacto Ambiental (AIA) prévia ao empreendimento/atividade efetivo, ou potencialmente causador de poluição e/ou degradação do meio ambiente, é a consecução dos princípios da precaução e da prevenção, assim como o monitoramento dos parâmetros ambientais garante o acompanhamento efetivo da performance ambiental estabelecida em cada um dos três tipos de licença ambiental possíveis de outorga, nos termos da Resolução n.o 237/1997 do Conselho Nacional do Meio Ambiente (Conama), quais sejam: Licença Prévia (LP), Licença de Instalação (LI) e Licença de Operação (LO). É diante desse contexto que exsurge o questionamento acerca da (in)constitucionalidade de novas tipologias de licença ambiental criadas diretamente pelas Unidades da Federação, com amparo formal na competência legislativa concorrente. Também se verifica que o legislador tem passado para o empreendedor a responsabilidade pela realização das medições dos parâmetros ambientais, imprescindíveis para a obtenção da licença ambiental sucessiva ou para a renovação da LO, o que caracteriza o Automonitoramento Ambiental. A incursão pelo cabedal doutrinário, legislativo e jurisprudencial revelou que o Autolicenciamento Ambiental padece de base constitucional por romper com o axioma da avaliação de impacto ambiental prévia, ao passo que a verificação da legislação comparada junto a 40 países, selecionados em razão da posição no Índice de Desempenho Ambiental (Environmental Performance Index — EPI), demonstrou que nenhum deles possui tal instituto em seu ordenamento jurídico ambiental. A conclusão é de que os referidos institutos jurídicos — Autolicenciamento e Automonitoramento — extrapolam a competência legislativa concorrente e burlam os princípios da precaução e da prevenção, incorrendo no retrocesso ambiental, razões pelas quais não são recepcionadas pela CRFB/1988 e pela Política Nacional do Meio Ambiente (PNMA).
