Since the passage in 1990 of the Americans with Disabilities Act, society has made considerable strides in improving the quality of life and the productivity of individuals with disabilities. At the same time, however, the American health care system has undergone considerable change, with some unforeseen consequences for those with disabilities. Since the mid-1990s, states have accelerated the enrollment of children with special needs in capitated MMC programs, which deliver medical services to beneficiaries for a fixed per-person fee. The Balanced Budget Act (BBA) of 1997 continued to require Federal approval for state Medicaid programs that mandate that these children enroll. This report: (1) presents data on the extent to which states are enrolling children with special needs, as defined in the BBA, in capitated MMC plans, & (2) assesses the scope & effectiveness of the safeguards that these states are implementing to ensure that children with special needs receive appropriate care within MMC.
