La matière de l’extinction des obligations est évolutive. Les choses paraissent figées alors qu’elles sont en réalité sujettes à des mouvements importants au gré de l’évolution du droit objectif. Dans ce contexte, la théorie générale des modes d’extinction des obligations reste à faire. Le présent ouvrage essaie d’y contribuer dans la mesure du possible, en tâchant de donner au sujet l’ampleur qu’il mérite. L’ouvrage offre une double entrée dans la matière, soit par mode d’extinction, soit par matière ou par question. Dans le premier cas, une étude est proposée d’un mode d’extinction identifié (dation en paiement, remise de dette, novation et délégation, confusion, déchéance et prescription). Dans le second cas, l’examen se fait à l’aune d’une matière ou question déterminée, en tenant compte de son contexte et des finalités poursuivies (droit des sûretés, procédures civiles d’exécution, droit du surendettement, procédures collectives). Le tout est bordé par une étude préliminaire sur le rôle du juge et une étude terminale sur la preuve de l’extinction, suivie d’une synthèse de l’ouvrage. Le résultat de recherches du présent ouvrage, nécessairement incomplet et perfectible, est susceptible d’inspirer d’autres chercheurs.

The 2005 Avant-projet de réforme du droit des obligations et de la prescription, also dubbed the Avant-projet Catala, suggests the most far-reaching reform of the French Civil code since it came into force in 1804. It reviews central aspects of contract law, the law of delict and the law of unjustified enrichment.
