The past forty years have seen a wide proliferation of an extensive range of disputes under international law concerning cultural heritage. These disputes can concern a disparate variety of issues. A substantial number of have concerned the restitution of stolen and illegally exported art objects. Another set of controversies has involved the protection of immovable cultural heritage. Unlike other fields of international law, international cultural heritage law does not have an ad hoc mechanism of dispute settlement. As a result, controversies are to be settled through negotiation or, if this fails, through existing dispute resolution means, which include arbitration and litigation before domestic courts or international tribunals. This ad hoc fashion of dealing with disputes is not without consequences. The most serious problem is that the same or similar cases may be settled in different ways, thereby bringing about an incoherent and fragmentary enforcement of the law. This book offers a comprehensive and innovative analysis of the settlement of cultural heritage disputes. It addresses the means the potential fragmentation can be resolved by providing a two-fold analysis. First, it provides a detailed analysis of the existing legal framework and the available means of judicial and non-judicial dispute settlement. Second, it explores the feasibility of two solutions for overcoming the lack of a specialized forum. The first potential solution is the establishment of a new international court. The second concerns existing judicial and extra-judicial fora and means of increasing interaction between them by the practice of 'cross-fertilization'. The book focuses on the substance of such interaction, and identifies a number of culturally-sensitive parameters which need to apply (the 'common rules of adjudication'). Ultimately the book argues that existing judicial and non-judicial fora should adopt a cross-fertilizing perspective to use and disseminate jurisprudence containing these common rules of adjudication, to enhance the effectiveness and coherence of their decision-making processes. Finally, it sets out how such an approach would be conducive to the development of a wider body of international cultural heritage law.

This book is an introduction to a new branch of archaeology that scrutinises landscapes to find evidence of past human activity. Such evidence can be hard to detect at ground-level, but may be visible in remote sensing (RS) imagery from aerial platforms and satellites. Culture and Language at Crossed Purposes unpacks the interpretive problems of colonial treaty-making and uses them to illuminate canonical works from the period. Classic American literature, Jerome McGann argues, is haunted by the betrayal of seventeenth- and eighteenth-century Indian treaties—“a stunned memory preserved in the negative spaces of the treaty records.” A noted scholar of the “textual conditions” of literature, McGann investigates canonical works from the colonial period, including the Arbella sermon and key writings of William Bradford, John Winthrop, Anne Bradstreet, Cotton Mather’s Magnalia, Benjamin Franklin’s celebrated treaty folios and Autobiography, and Thomas Jefferson’s Notes on the State of Virginia. The crucial role that the Ukrainian 'branch' of the Tripolye culture played in shaping the historical formation of the Ukraine, and indeed that of Europe, is still not fully understood or appreciated. Although we are mostly aware of its finely-crafted and decorated pottery, along with the highly-discussed house architecture and huge settlements (known as 'giant-settlements'), we often fail to connect the various dots in order to understand the different aspects of its development, from the very first eastward migrations, to the scission into two separate local groups (eastern and western Tripolye culture), the formation of the so-called giant-settlements, and finally to its inexorable decline after more than 2000 years of prosperous existence. This book attempts to bring together in English a variety of research traditions of Eastern and Western Europe, traditionally published in various languages and not readily accessible to all scholars, in the examination of the Ukrainian archaeological record. The volume has been organized so as to give the reader a clear image of the Tripolye culture in the Ukraine, with a special emphasis placed upon the development of the so-called 'giant-settlements'. Chapters discuss the geographical and chronological context, highlighting the different facets of the culture that resulted in the formation of the giant-settlements; relative and absolute chronology of the many subgroups identified; migration; aspects of material culture (pottery and clay figurines, flint artifacts); architecture (settlement layout, house typology and standardized internal structures); experimental work on the construction and destruction of houses and controversial use of fire; and the ultimate disappearance of this accomplished and very long-lived cultural group.
