Nearly two decades after the declaration of a ‘War on Terror,’ the precise relationship between warfare and terrorism remains unclear. The United States and its allies have long sought to inflict a decisive defeat upon groups such as Al Qaeda and ISIS, while regarding their individual members as malevolent criminals undeserving of combatant status. A clearer understanding of how terrorists define victory, and how their method of fighting relates to conventional military forces, is necessary in order to devise more realistic and effective strategies of counterterrorism. On Absolute War constructs a theoretical framework for the study of terrorism based on Carl von Clausewitz’s On War, widely regarded as the greatest analysis of war ever written. Through a review of Clausewitz’s work and a set of historical case studies ranging from the Fenian Dynamite Campaign of the 1880s to the wars in Iraq and Afghanistan, Prof. Fleury reveals just how closely terrorism mimics the logic of war. Terrorism attempts to restore war to its theoretical baseline, a condition that Clausewitz called ‘absolute war’ featuring relentless escalation toward a climactic result. While never achieving this ideal in practice, terrorists succeed to the extent that they compel their enemies and their prospective followers to engage mutual escalation, which will ultimately favor whichever side is better able to jettison logistical and normative limits. Consequently, states must engage terrorists on the basis of Clausewitz’s two most important injunctions, namely that war is temporary and subordinate to political controls. Given the very real prospect of a war without any temporal and spatial limits, On Absolute War provides the theoretical basis for a strategy of limiting the effects of terrorism, rather than repeatedly trying and failing to destroy it.

Then there will be an analysis of the moral pitfalls and benefits inherent in the individual methods of counterterrorism. After that I will show how these methods have been applied practically by analyzing U.S domestic counterterrorism and U.S counterterrorism in the Middle East. The findings of this paper will show that U.S counterterrorism since 9/11 has consistently violated just war moral principles, but is ultimately morally unjustifiable because it has not provided a good chance of success for preventing terrorism.

This monograph is the ninth offering in the Combat Studies Institute's (CSI) Global War On Terrorism (GWOT) Occasional Papers series. The author, a retired Army lieutenant colonel and CSI historian, has produced a study that examines the evolution and continued applicability of the corpus that constitutes the law of war. As background, he provides a theoretical framework and the development of the law within Western and, specifically, U.S. Army doctrine and regulation. He then presents a case study of the British suppression of the Mau Mau insurgency between 1952 and 1960 in Kenya, a conflict with particular resonance today. Some of the more relevant characteristics of the conflict include the clash between Western and non-Western cultures and an initially asymmetric fight between conventional security forces and loosely organized, poorly equipped insurgents. It makes no claim that every lesson learned by the British during that counterinsurgency operation can be directly applied by the United States to the challenges of the GWOT, but this analysis does offer some insight about applying the law of war to an unfamiliar, non-Western environment. The genesis of this study is the public discourse asserting the possibility that the GWOT may require new rules and new law-of-war prescripts. This important discussion is fraught with complexities and long-term implications; the moral force in warfare is incredibly significant and any changes to the legal framework in place must be very carefully considered. Do we follow the law of war to the letter, do we remain consistent with the principles of Geneva, or do we approach the conflict as a new challenge requiring fundamental revisions to the law? According to the author, law-of-war violations are neither necessary nor excusable for successful prosecution of military operations in any environment, and because the law of war in its current form is more than adequate to face the new GWOT challenges, it does not warrant revision.

In 2014, a resurgent and bellicose Russia took over Crimea and fueled a civil war in Eastern Ukraine; post-Saddam Iraq lost a third of its territory to an army of hyper-violent millennialists; and the peace process in Israel seemed to completely collapse. In short, the post-Cold War security order that the US had constructed after 1991 seemed to be coming apart at the seams. David Kilcullen was one of the architects of America's strategy in the late phases of the second Gulf War, and he has also spent time in Afghanistan and other hotspots. In Blood Year, he provides a wide-angle view of the current situation in the Middle East and analyzes how America and the West ended up in such dire circumstances. Kilcullen lays much of the blame on Bush's initial decision to invade Iraq (which had negative secondary effects in Afghanistan), but also takes Obama to task for simply withdrawing and adopting a "leading from behind" strategy. As events have proven, Kilcullen contends, withdrawal was a fundamentally misguided plan. The U.S. had uncorked the genie, and it had a responsibility to at least attempt to keep it under control.
