Constructing Victimhood seeks to go 'beyond innocence and guilt' to expand the criminological, victimological, and transitional justice image of who we 'see' as victims, what we 'hear' as experiences of victimisation, and who makes these determinations. The book argues that the construction, reproduction, and politicisation of victimhood is structured not only by notions of innocence and guilt and the existence of complex victims, but by larger questions concerning the existence of complex hierarchies of victimhood that supersede simplistic notions of 'good' and 'bad' victims. Lawther also considers the exercise of voice, the role of silence and the silencing of certain variants of victimhood (in gender-based crimes for example), the politicisation of victims' groups and the impact of unresolved legacies of violent conflict. The author argues that in the failure to cast the transitional justice gaze more widely it is not only the 'voices in the cracks' that will be overlooked, but entire experiences of victimhood and victimisation. If transitional justice is to live up to its claims of being 'victim centred', widening its conceptual and practical boundaries to recognise the multiple and overlapping variables that construct and reproduce victimhood is essential. Pursuing this line of enquiry, Constructing Victimhood aims to change our understanding of victimhood in post-conflict and transitional contexts.

The post-war Federal Republic of Germany faced the task of addressing the plight of the victims of state socialism under the Soviet occupation of eastern Germany and in the German Democratic Republic, many of whom fled to the west. These victims were not passive objects of the West German state’s policy, but organized themselves into associations that fought for recognition of their contribution to the fight against communism. After German unification, the task of commemorating and compensating these victims continued under entirely new political circumstances, yet also in the context of global trends in memory politics and transitional justice that give priority to addressing the fate of victims of non-democratic regimes. Constructions of Victimhood: Remembering the Victims of State Socialism in Germany draws on the constructivist systems theory of Niklas Luhmann to analyze the role of victims organizations, the political system, and historians and heritage professionals in the struggle over the memory of suffering under state socialism, from the Cold War to the present day. The book argues that the identity and social role of victims has undergone a process of constant renegotiation in this period, offering an innovative theoretical framework for understanding how restorative measures are formulated to address the situation of victims. As such, it offers not only insights into a neglected aspect of post-war German history, but also contributes to the ongoing academic debate about the role of victims in process of transitional justice and the politics of memory.

Inhabitants of Medellín, Colombia, suffered from the war-like violence perpetrated by drug cartels and other actors in the 1980s and 1990s; thousands died, including innocent civilians, judges, and journalists, many more were injured and left with psychological trauma. Three decades later, however, transnational audio-visual corporations such as Netflix have transformed the traumatic memories into entertainment and the main perpetrator, Pablo Escobar, was converted into a brand. While global audiences learn about Escobar's life and myth, his victims's stories fade into oblivion. Victimhood, Memory, and Consumerism: Profiting from Pablo documents the story of violence that took place in Medellín and critically examines the position of its victims. Drawing on unique empirical material, the book addresses the consequences of commercial exploitation of the city's violent past for victims of mass drug violence, and for the present nature of the city. To demonstrate the magnitude of the profits made from the legacy of Pablo Escobar, the authors cover a range of topics. Firstly, they describe how the immense popularity of narco-series has caused the city's suffering to be appropriated by commercial forces to entertain global audiences; secondly, they detail the Escobar tours, souvenirs, and artefacts offered by Medellín's tourist industry; and, finally, they expose the less visible profits made by political and social actors who engage in the global mythmaking surrounding Escobar. Through interviews with those directly affected by drug violence, the authors show that these cultural forces have immediate symbolic and material consequences. Government wrongdoing or negligence harms people worldwide, but not all victims are equally effective at obtaining redress. In Accidental Activists, Celeste L. Arrington examines the interactive dynamics of the politics of redress to understand why not. Relatively powerless groups like redress claimants depend on support from political elites, active groups in society, the media, experts, lawyers, and the interested public to capture democratic policymakers' attention and sway their decisions. Focusing on when and how such third-party support matters, Arrington finds that elite allies may raise awareness about the victims’ cause or sponsor special legislation, but their activities also tend to deter the mobilization of fellow claimants and public sympathy. By contrast, claimants who gain elite allies only after the difficult and potentially risky process of mobilizing societal support tend to achieve more redress, which can include official inquiries, apologies, compensation, and structural reforms.Arrington draws on her extensive fieldwork to illustrate these dynamics through comparisons of the parallel Japanese and South Korean movements of victims of harsh leprosy control policies, blood products tainted by hepatitis C, and North Korean abductions. Her book thereby highlights how citizens in Northeast Asia—a region grappling with how to address Japan’s past wrongs—are leveraging similar processes to hold their own governments accountable for more recent harms. This book critically examines the relationship between protecting human rights and building peace in post-violence societies. It explores the conditions that must be present, and strategies that should be adopted, for the former to contribute to the latter. The author argues that human rights can aid peacebuilding efforts by helping victims of past violence to articulate their grievance, and by encouraging the state to respond to and provide them with a meaningful remedy. This usually happens either through a process of adjudication, whereby human rights can offer guidance to the judiciary as to the best way to address such grievances, or through the passing and implementation of human rights laws and policies that seek to promote peace. However, this positive relationship between human rights and peace is both qualified and context specific. Through an interdisciplinary and comparative analysis of four case studies, the book identifies the conditions that can support the effective use of human rights as peacebuilding tools. Developing these, the book recommends a series of strategies that peacebuilders should adopt and rely on. Winner of the Constantinos Emilianides Award in Law for 2020 (joint conferment).
