Higher education legislation is frequently changed by policy makers, who are acutely conscious that specific changes have repercussions through the law of general applicability, and eventually may alter and revise fundamental societal concepts. However, normative systems are complex, and the impact and direction of legal and social repercussions are neither always intended, nor are they easily foreseen. It is the purpose of this book to identify the chosen directions, and to contribute to the further development of issues in the higher education and research sector and to trace beginnings of new trends. This volume is intended to appeal to the reader's personal, practical perspective to help generate the creativity and inspiration needed in order to maintain the equilibrium between consolidation and change. In the Council of Europe, much thought has been given to these problems in recent years. The Higher Education and Research Committee (CC-HER), previously known as the Standing Conference of University Problems (CC-PU), has established a Legislation Reform Programme for Higher Education (LRP). The Programme is intended to give effective support to the process of legislative reform in higher education, particularly, but not exclusively, in the new member states in central and eastern Europe. To promote dissemination of experience acquired throughout Europe and as a complement to its ongoing advisory and multilateral activities, the Programme's Steering Group has decided to publish a series entitled `Legislating for Higher Education and Research in Europe'. The first volume of this series, Relations between State and Higher Education, is hereby presented to the general public. This volume revisits the book edited by David Phillips and Michael Kaser in 1992, entitled Education and Economic Change in Eastern Europe and the Former Soviet Union (https://doi.org/10.15730/books.42). Two and a half decades later, this volume reflects on how post-socialist countries have engaged with what Phillips & Kaser called ‘the flush of educational freedom’. Spanning diverse geopolitical settings that range from Southeast and Central Europe to the Caucasus and Central Asia, the chapters in this volume offer analyses of education policies and practices that the countries in this region have pursued since the fall of the Berlin Wall and the dissolution of the Soviet Union. This book explores three interrelated questions. First, it seeks to capture complex reconfigurations of education purposes during post-socialist transformations, noting the emergence of neoliberal education imaginaries in post-socialist spaces and their effects on policy discussions about education quality and equity across the region. Second, it examines the ongoing tensions inherent in post-socialist transformations, suggesting that beneath the surface of dominant neoliberal narratives there are always powerful countercurrents – ranging from the persisting socialist legacies to other alternative conceptualizations of education futures – highlighting the diverse trajectories of post-socialist education transformations. And finally, the book engages with the question of ‘comparison’, prompting both the contributing authors and readers to reflect on how research on post-socialist education transformations can contribute to rethinking comparative methods in education across space and time.

Universities have never been static. Even so, it is fair to say they have experienced a most radical transformation in the past twenty years. During this period, the role and responsibility of the state generally have been broadly limited while allowing ‘market forces’--private ownership and control--more influence. But even where the state is still the main provider or funder, it relies increasingly on ‘market mechanisms’, for example contractual relations between state and institutions, competition among providers for resources, and external assessment of ‘outputs’ which means the results or impact of what universities do, in particular teaching and research. The new terminology speaks of price and competition, inputs and outputs, resources, cost and benefits, demand and supply, provider and customer, consumers and investors, quality control and accountability. Education, and post-secondary education especially are increasingly seen as matters for markets. Formal post-secondary education becomes a service, commercialized and traded across national borders. This volume on changing relationship between state and market, contains, besides an introductory analytic overview of the issues, accounts from different countries, regions, and thematic perspectives. Chapter authors describe and analyze government reforms and other developments that have directly or indirectly affected this relationship. Although the geographical focus is on North America, especially Mexico, South East Asia and Europe, the phenomenon is not limited to these regions and countries but worldwide.
