This book addresses the viability of the EU economic and social model within and after the global economic crisis. It identifies four key issues which warrant further discussion: (1) the asymmetry of the legal and policy framework of the euro and potential recalibration; (2) substantive tensions between the EU ’economic constitution’ and its normative aim of social justice and impacts on national policy; (3) the role of civil society, including the two sides of industry in overcoming these tensions; and (4) the EU’s global aspirations towards the creation of a viable socio-economic model. Politically sensitive and economically important, welfare services such as health care, health insurance and education have opened up a heated debate in the EU. The application of EU law to welfare services raises discontent from the part of the Member States who perceive their systems to be under threat. Resisting to the application of the EU law is sometimes seen as part of protecting those values. This book suggests that this resistance is largely unjustified. EU law is not damaging to welfare systems, but it provides adequate balancing mechanisms to ensure that all interests are protected. The approach taken in analysing the impact of EU law on welfare services is to look at the negative integration process and answer the questions related to the extent to which EU law applies to welfare services and the kinds of safeguards the Court offers for these services. The proportionality principle distinguishes itself as the central element in balancing national and Community interests. Being part of the broader integration process, negative harmonization creates legislative lacunae, and therefore, this book also looks at alternative solutions to the negative harmonization process, namely positive and soft law.

According to the European Commission, two recent policies: the Digital Service Act and the Digital Market Act will allow for the regulation of a significant part of the EU Digital Single Market (DSM), to an extent similar to the creation of the traditional internal market in the early 1990s. The provisions are intended to improve conditions in the EU DSM to ensure that the market is as free and fair as it is safe for users of the digital economy. This interdisciplinary book analyses the impact of digital technologies on specific markets and, more broadly, the society and the economy. It identifies and assesses the different features, challenges, trends and dimensions of the EU DSM, from a legal and economic viewpoint, and also from a Polish perspective. Poland is presented as one of the EU countries participating in the creation of the EU DSM and is analysed alongside the average, as well as the best and the worst performing EU member states and compared with other non-EU members. The book addresses several broad areas in which the implications of digitalisation are particularly visible, and which are important to the average person: giant online platforms, freedom of speech, e-commerce, digital levy, energy infrastructure, and the labour market. The EU has limited legislative competence in the field of social law. However, the Member States are increasingly modernizing social services and social (welfare) protection, attempting to make social services more efficient by increasingly looking to the market for the provision of such services. This policy move brings social services into the radar of EU law. The EU response to this sensitive issue has resulted in a piecemeal and fragmented approach towards the treatment of a new policy area of Social Services of General Interest (SSGI) in EU law and policy.
