Créée par le décret du 17 février 1995 pour apprécier la compatibilité avec leurs fonctions précédentes des activités privées exercées par les fonctionnaires et agents publics quittant définitivement ou provisoirement l'administration, la commission de déontologie a été chargée en outre, par la loi du 12 juillet 1999, d'émettre des avis sur les autorisations dont les chercheurs peuvent bénéficier pour participer à la création ou aux activités d'entreprises valorisant leurs travaux de recherche. Comme les précédents rapports depuis 1999, ce dixième rapport est divisé en deux parties consacrées respectivement aux deux compétences de la commission. Chacune de ces parties comprend un bilan statistique et une analyse de jurisprudence. Cette année, l'analyse de jurisprudence concernant l'application du décret du 17 février 1995 ne porte pas seulement sur les avis rendus clans l'année, mais sur l'ensemble des avis émis au cours des dix années de fonctionnement de la commission. Ce rapport permettra ainsi aux fonctionnaires et agents publics, aux autorités dont ils dépendent et à tous ceux qui s'intéressent au phénomène dit du " pantouflage ", d'être pleinement éclairés sur les règles déontologiques qui s'imposent aux agents souhaitant quitter l'administration pour exercer une activité privée.

Dans la continuité des débats ouverts lors de l’examen de la loi pour la confiance dans la vie politique, la commission des Lois a confié à 18 de ses membres une mission d’information pour faire un premier bilan des évolutions intervenues en matière de déontologie et d’encadrement des conflits d’intérêts pour les agents publics. Fabien Matras et Olivier Marleix, respectivement président-rapporteur et vice-président et co-rapporteur, ont souhaité établir un état des lieux documenté en procédant à de nombreuses auditions rassemblant des acteurs aussi bien issus du secteur public que du secteur privé. Sur un total de plus de trente-trois heures d’auditions, dix-huit auditions et sept tables rondes ont été organisées. Le rapport d'information considère que le cadre légal, tel que modifié en 2016, apparaît aujourd’hui suffisant à condition que le dispositif gagne en transparence et que les contrôles soient effectifs. Fort de ce constat, les Rapporteurs proposent d’abord de renforcer les outils statistiques et d’améliorer la formation initiale et continue pour que tous les agents publics s’approprient ces questions. Mais ces évolutions doivent surtout s’accompagner d’un renforcement de la transparence passant en particulier par une publicité systématique des avis de la commission de déontologie. D'après le rapport d'information, les organes de contrôle doivent par ailleurs être dotés de moyens permettant de vérifier que leurs recommandations ou réserves sont effectivement respectées. La commission de déontologie et la Haute Autorité pour la transparence de la vie publique pourraient ainsi fusionner pour former une nouvelle autorité administrative indépendante, référence nationale en matière de déontologie et d’encadrement des conflits d’intérêts.
