Le décret de 1981 a bouleversé le droit de l'arbitrage international en le détachant de l'ordre juridique français pour le rattacher à un ordre juridique tiers. Du fait de ce présupposé doctrinal, le droit français est devenu l'exception dans le droit comparé de l'arbitrage international. La réforme proposée par le Comité français de l'arbitrage, si elle devient du droit positif, sera un bouleversement en sens inverse, qui ramènera le droit de l'arbitrage international dans le giron de l'ordre juridique français et mettra fin au mythe du tiers ordre juridique. On ne peut qu'approuver le texte proposé sur la convention d'arbitrage, la constitution du tribunal arbitral, l'instance arbitrale et la sentence, sauf à combler les lacunes de ce texte et à reconsidérer la définition proposée de l'arbitrage international. Quant aux textes proposés sur les voies de recours, les concepteurs du droit en vigueur ont substitué aux dispositions claires de la Convention de New York, jugées teintes de conflictualisme, des dispositions supposées plus favorables à l'exécution des sentences. Mais encore faut-il que ces dispositions édictent des règles bien définies, bien identifiées. Or ces dispositions se révèlent tronquées, et les règles qu'elles édictent demeurent non identifiables. La jurisprudence censée les éclairer est encore plus énigmatique. Les textes en vigueur sur les voies de recours, modifiés par le Comité français de l'arbitrage en vue de les parfaire et de rendre exhaustive la liste des cas qu'ils embrassent, débouchent paradoxalement sur un retour pur et simple à la Convention de New York.
