Book Description
This book provides the first comprehensive account of the origins of Australian trade mark law, situated in the colonial trade mark regime. It examines the movement of trade mark law from Great Britain to the Australian colonies, while also using colonial trade mark law and its registrations as a way of understanding significant aspects of colonial development. In doing so, this book traverses broad themes such as the complex relationship between the Imperial power and the colonies, settler identity, colonial economics and commerce, and the emergence of branding in Australia.

Book Description
During the post-abolition period a trade in cheap and often cost-neutral labor flourished in the western Pacific. For more than forty years, it supplied tens of thousands of indentured laborers to the sugar industry of northeastern Australia. Violence and Colonial Dialogue tells the story of its impact on the people who were traded. From the beaches and shallows of the Pacific’s frontiers to the plantations and settlements of Queensland and beyond, a collective tale of the pioneers of today’s Australian South Sea Island community is told through an abundant and effective use of materials that characterize the colonial record, including police registers, court records, prison censuses, administrative reports, legislative debates, and oral histories. With a thematic focus on the physical violence that was central to the experience of people who were voluntarily or involuntarily recruited, the history that emerges is a powerful tale that is at once both tragic and triumphant. Violence and Colonial Dialogue also tells a more universal story of colonization. Set mostly in the British settler-colony of Queensland during the last forty years of the nineteenth century, it explores the brutality embedded in the structures of a colonial state, while attempting to recover the stories that such processes obscured.

Book Description
Australian Trade Mark Law Second Edition provides a comprehensive overview of trade mark law in Australia and encourages readers to critically engage with the operation of the Australian trade mark system as a whole. It moves beyond a purely descriptive account of existing legislation and case law to help readers to view and question the law through a critical lens. It questions the functioning of the trade mark system as well as the decisions made by courts, the legislature and administrative bodies that have shaped such a system. As well as critically assessing how the trademark system could work better in the future, Australian Trade Mark Law presents comparative material that illustrates how other jurisdictions deal with particular issues and problems.

Book Description
Intellectual property law in Australia has changed dramatically in the last decade and continues to change. Developments in technology, the rise of the internet, the globalisation of trade and the increasing importance of 'superbrands' or trade marks with global appeal have all impacted on the laws surrounding intellectual property. Furthermore, globalisation has resulted in greater pressure to expand the rights of intellectual property owners as they endeavour to capture the potential benefits of ownership in an increasingly affluent and integrated world economy. This book provides a detailed and scholarly insight into Australian intellectual property law. It aims to offer students and legal professionals a detailed discussion of the black-letter aspects of the law, with the primary emphasis on the legal principles and complexities within.

Book Description
We live in an age in which expressive, informational, and technological subject matter are becoming increasingly important. Intellectual property is the primary means by which the law seeks to regulate such subject matter. It aims to promote innovation and creativity, and in doing so to support solutions to global environmental and health problems, as well as freedom of expression and democracy. It also seeks to stimulate economic growth and competition, accounting for its centrality to EU Internal Market and international trade and development policies. Additionally, it is of enormous and increasing importance to business. As a result there is a substantial and ever-growing interest in intellectual property law across all spheres of industry and social policy, including an interest in its legal principles, its social and normative foundations, and its place and operation in the political economy. This handbook written by leading academics and practitioners from the field of intellectual property law, and suitable for both a specialist legal readership and an intelligent but non-specialist legal and non-legal readership, provides a comprehensive account of the following areas: - The foundations of IP law, including its emergence and development in different jurisdictions and regions; - The substantive rules and principles of IP; and - Important issues arising from the existence and operation of IP in the political economy.
