Le droit de l'Union africaine est une synthèse du droit international qui s'élabore en Afrique depuis plus d'une cinquantaine d'années. II expose le cadre de négociation et d'élaboration des règles applicables aux Etats et aux personnes en Afrique, et présente l'Union africaine dans ses deux aspects fondamentaux : son système institutionnel et son cadre décisionnel. Depuis 2000, en succédant à l'ancienne Organisation de l'unité africaine (OUA), l'Union africaine impulse un nouveau système institutionnel (par la Conférence des Chefs d'Etats, le Conseil de paix et de sécurité, le Nouveau Partenariat pour le développement de l'Afrique ou Nepad, etc.). Les Etats d'Afrique ont mis en place un nouveau système décisionnel avec ses propres mécanismes. La Cour africaine de justice et des droits de l'Homme, qui deviendra bientôt une Cour africaine unique, rend de plus en plus de jurisprudences. Le droit international en Afrique est déjà une donnée objective, comme en attestent de nombreux documents tels la Charte africaine des droits de l'Homme et des Peuples (1981), celle sur la démocratie, les élections et la gouvernante (2007) ou encore la mise en place en 2009 de la Commission de l'Union africaine pour le droit international. En visant l'intégration de toutes les nations africaines et en allant au-delà du droit classique des organisations internationales, le droit de l'Union africaine s'inscrit dans une dynamique véritablement continentale.

The African Convention on the conservation of nature and natural resources was adopted in 1968 in Algiers. Considered the most forward looking regional agreement of the time, it influenced significantly the development of environmental law in Africa. Two and a half decades of intense developments in international environmental law made it necessary to revise this treaty, update its provisions and enlarge its scope. This was undertaken under the auspices of the African Union (previously OAU), and the revision was adopted by its Heads of State and Government in July 2003 in Maputo. The introduction provides an overview of this new international treaty, as well as a commentary to each of its provisions.

Spaces of Responsibility explores the role of ethics in (re)ordering extractive relations under the global condition. Through an empirical investigation of actors, places, and ideas in and around Burkina Faso’s industrial gold mining sector, this volume carries out an anti-essentialist yet critical examination, offering new insights into global mining capitalism. Corporate concession-making practices, the implementation of (national) mining legislation, and civil society interventions in mining areas all contribute in different ways to the dialectics of the global. Accordingly, the ongoing territorialization of mining investment often has considerable impacts on the well-being of populations in the Global South. At the same time, multinational corporations today cannot completely distance or isolate themselves from the political, economic, and social contexts they are interacting in and with. Drawing on theoretical debates about the links between resource extraction and socio-economic development, multi-scalar negotiations of ethics in mining governance are ethnographically retraced. In terms of gains and benefits, these negotiations manifest themselves spatially, providing access for some actors while excluding others.
