Archiving Sovereignty shows how courts use fiction in their treatment of sovereign violence. Law's complicity with imperial and neocolonial practices occurs when courts inscribe and repeat the fabulous tales that provide an alibi for archaic sovereign acts that persist in the present. The United Kingdom's depopulation of islands in the Indian Ocean to serve the United States' neoimperial interests, Australia's exile and abandonment of refugees on remote islands, the failure to acknowledge genocidal acts or colonial dispossession, and the memorial work of the South African Constitution after apartheid are all sustained by historical fictions. This history-work of law constitutes an archive where sovereign violence is mediated, dissimulated, and sustained. Stewart Motha extends the concept of the "archive," as site of origin and source of authority, to signifying what law does in preserving and disavowing the past at the same time. Sovereignty is often cast as a limit-concept, constituent force, determining the boundary of law. Archiving Sovereignty reverses this to explain how judicial pronouncements inscribe and sustain extravagant claims to exceptionality and sovereign solitude. This wide-ranging, critical work distinguishes between myths that sustain neocolonial orders and fictions that generate new forms of political and ethical life.

As the global ‘data revolution’ accelerates, how can the data rights and interests of indigenous peoples be secured? The Sovereignty Solution is not an Establishment national security strategy. Instead, it describes what the U.S. could actually do to restore order to the world without having to engage in either global policing or nation-building. Currently there is no coherent plan that addresses questions like: If terrorists were to strike Chicago tomorrow, what would we do? When Chicago is burning, whom would we target? How would we respond? There is nothing in place and no strategy on the horizon to either reassure the American public or warn the world: attack us, and this is what you can expect. In this book, a Naval Postgraduate School professor and her Special Forces coauthors offer a radical yet commonsensical approach to recalibrating global security. In the seventeenth century, even as the Spanish Habsburg monarchy entered its irreversible decline, the capital of its most important overseas territory was flourishing. Nexus of both Atlantic and Pacific trade routes and home to an ethnically diverse population, Mexico City produced a distinctive Baroque culture that combined local and European influences. In this context, the American-born descendants of European immigrants—or creoles, as they called themselves—began to envision a new society beyond the terms of Spanish imperialism, and the writings of the Mexican polymath Carlos de Sigüenza y Góngora (1645-1700) were instrumental in this process. Mathematician, antiquarian, poet, and secular priest, Sigüenza authored works on such topics as the 1680 comet, the defense of New Spain, pre-Columbian history, and the massive 1692 Mexico City riot. He wrote all of these, in his words, "out of love for my patria." Through readings of Sigüenza y Góngora's diverse works, Baroque Sovereignty locates the colonial Baroque at the crossroads of a conflicted Spanish imperial rule and the political imaginary of an emergent local elite. Arguing that Spanish imperialism was founded on an ideal of Christian conversion no longer applicable at the end of the seventeenth century, More discovers in Sigüenza y Góngora's works an alternative basis for local governance. The creole archive, understood as both the collection of local artifacts and their interpretation, solved the intractable problem of Spanish imperial sovereignty by establishing a material genealogy and authority for New Spain's creole elite. In an analysis that contributes substantially to early modern colonial studies and theories of memory and knowledge, More posits the centrality of the creole archive for understanding how a local political imaginary emerged from the ruins of Spanish imperialism.
