El presente trabajo permite al lector conocer los aspectos más importantes del complejo derecho humano de acceso a la justicia y sin el cual no podemos concebir a los demás derechos humanos, puesto que ningún derecho puede ser salvaguardado sin los mecanismos adecuados de tutela que permitan al justiciable exigir su respeto y en su caso que le sean reparados los daños y restituidos los derechos vulnerados. Su contenido incluye los conceptos esenciales vinculados al derecho en cuestión, así como relevantes implicaciones del mismo, tales como la problemática de la impunidad en materia de violencia de género, como una cuenta pendiente de los estados modernos, que han sido ineficaces para resolverla. De igual manera atiende a la diversa problemática que viven muchos de nuestros connacionales ante la imposibilidad de acceder, en países a los que ingresan de forma clandestina, a una justicia que les está vedada por su propia condición de ilegalidad. No podemos dejar de lado el análisis de la situación a la que se han enfrentado las víctimas de tantas dictaduras en el mundo y de forma más sensible para nosotros, las de América, así como las dificultades que han enfrentado para alcanzar la escasa justicia lograda a la fecha. Como corolario se procede a examinar la incidencia que la Corte Interamericana de Derecho Humanos ha alcanzado en la construcción de este derecho humano, tarea nada baladí, si tomamos en consideración que es dicho tribunal internacional el que más ha fortalecido el derecho humano en cuestión.

Natural disasters and the dire effects of climate change cause massive population displacements and lead to some of the most intractable political and humanitarian challenges seen today. Yet, as Maria Cristina Garcia observes in this critical history of U.S. policy on migration in the Global South, there is actually no such thing as a "climate refugee" under current U.S. law. Most initiatives intended to assist those who must migrate are flawed and ineffective from inception because they are derived from outmoded policies. In a world of climate change, U.S. refugee policy simply does not work. Garcia focuses on Central America and the Caribbean, where natural disasters have repeatedly worsened poverty, inequality, and domestic and international political tensions. She explains that the creation of better U.S. policy for those escaping disasters is severely limited by the 1980 Refugee Act, which continues to be applied almost exclusively for reasons of persecution directly related to politics, race, religion, and identity. Garcia contends that the United States must transform its outdated migration policies to address today's realities. Climate change and natural disasters are here to stay, and much of the human devastation left in their wake is essentially a policy choice.
