The plaintiffs having acquired the property, so that it was at their risk, the question is, whether they have proved such an assignment of the contract as to bring themselves within the provisions of the charter and by-laws, as assignees, holding in all respects the rights of the original assured. The reafon alligned for this is, that, by the marine law, an indg'inite innavigability is never claffed among the perils to which the infurer is liable; be cattfe a thing fo fubjeel to be injured by time and the ufe which is made of it, cannot be fuppofed always to retain its original ilate; and that, though a {hip may, at the time of her departure, appear capable of performing the voyage infured; yet, if the voyage fhould prove longer than afnal, her internal defeets will fometimes become apparent, from time, from the preifure of the cargo, and from the a&ion of the feas, without any extraordinary accident.
